Property, Stock and Business Agents Amendment (Exemptions) Regulation 2012

Property, Stock and Business Agents Act 2002

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Property, Stock and Business Agents Act 2002.

Explanatory note
The object of this Regulation is to provide an exemption for persons who are authorised to act on behalf of any government department of the State of New South Wales or the Commonwealth, or any statutory body representing the Crown in right of the State or the Commonwealth, from the requirement under the Property, Stock and Business Agents Act 2002 to hold a licence. Consequently, any employee of such a person is not required to hold a certificate of registration under that Act.

This Regulation is made under the Property, Stock and Business Agents Act 2002, including sections 5 and 230 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Property, Stock and Business Agents Amendment
(Exemptions) Regulation 2012.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Property, Stock and Business Agents Regulation 2003

Clause 47B

Insert after clause 47A:

47B Exemption for persons acting on behalf of government
departments and certain statutory bodies

For the purposes of section 5 (1) of the Act, a person who is authorised to act on behalf of any government department of the State of New South Wales or the Commonwealth, or any statutory body representing the Crown in right of the State or the Commonwealth, is prescribed as a person who is not required to hold a licence under the Act (but only in relation to functions exercised by the person while acting on behalf of the department or statutory body).
