Property Agents and Land Transactions Amendment (Exemptions) Regulations 2014

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Property Agents and Land Transactions Act 2005 .18 June 2014

1Short titleThese regulations may be cited as the Property Agents and Land Transactions Amendment (Exemptions) Regulations 2014 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Property Agents and Land Transactions Regulations 2006 are referred to as the Principal Regulations. 4Regulation 43A amended (Exemption from application of Act) Regulation 43A of the Principal Regulations is amended by inserting after subregulation (2) the following subregulations: (3)  A person who acts as a property manager in relation to property – (a) that is held by the Director of Housing for and on behalf of the Crown in accordance with section 5 of the Homes Act 1935 ; and (b) in respect of which a residential management agreement, within the meaning of section 16A of the Residential Tenancy Act 1997 , is in force between the Director of Housing and another person – is, in relation to that property, exempt from the application of the Act. (4)  In this regulation – Director of Housing means the Director of Housing appointed pursuant to the Homes Act 1935 .
