  1. The applicant applies for special leave to appeal from two judgments of the Court of Appeal of the Supreme Court of Victoria (Ferguson CJ, Kennedy and Macaulay JJA), which allowed one appeal from a judgment of the Supreme Court of Victoria (Digby J) and dismissed another appeal from the same judgment.

  2. The point of principle sought to be raised by the applications for special leave to appeal does not have sufficient prospects of success to warrant a grant of special leave to appeal. The balance of the applications do not raise any question of law of public importance.

  3. Special leave to appeal is refused with costs.
