PROHIBITED WEAPONS ACT 1989—REGULATION
(Relating to the use of prohibited items by officers of the Department of Juvenile
Justice and Sheriff’s officers)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Prohibited Weapons Act 1989, has been pleased to make the Regulation set forth hereunder.

The Prohibited Weapons Regulation 1990 is amended:
(a)
by omitting clause 1 (d) of Schedule 1 and by inserting instead the following paragraph:
(d) Sheriff’s officers; and
(b)
by omitting from clause 1 of Schedule 1 the words “as officers of that Department engaged in custodial duties at institutions conducted by that Department” and by inserting instead the words “as Sheriff’s officers”;
(c)
by omitting clause 3 (d) of Schedule 1 and by inserting instead the following paragraph:
(d)
officers and employees of the Department of Juvenile Justice; and
(d)
by inserting in clause 3 of Schedule 1 after the words “as officers” the words “or employees”.

EXPLANATORY NOTE
The objects of this Regulation are to amend Schedule 1 to the Prohibited Weapons
Regulation 1990:
| (a) | to add Sheriff’s officers to the list of persons that may possess and use side-handled batons (which are prohibited weapons); |
| (b) | to omit the reference to officers of the former Department of Family and Community Services from that list, as those batons are not used by the Department of Juvenile Justice, the Department that currently carries out the functions of the former Department; |
| (c) | to insert reference to officers (and other employees) of the Department of Juvenile Justice (instead of the reference to officers of the former Department of Family and Community Services) in the list of persons that may possess and use handcuffs (which are prohibited articles). |
This Regulation is made under sections 5 (Possession or use of prohibited weapons), 6 (Possession or use of prohibited articles) and 20 (Regulations) of the Prohibited Weapons Act 1989.
