PROHIBITED WEAPONS ACT 1989—-REGULATION

(Relating to a temporary amnesty for firearms)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Prohibited Weapons Act 1989, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 July 1994.

Amendment

2. The Prohibited Weapons Regulation 1990 is amended by inserting

after Part 5 the following Part:

PART 6—GENERAL

Temporary amnesty for surrender of firearms

13. (1) T h s clause applies to any prohibited weapon that is a firearm

as defined in the Firearms Act 1989.

(2) A person is authorised by this clause to possess (but not use) a prohibited weapon to which this clause applies, but only for the following purposes:

Police by delivering it, in accordance with such guidelines as surrendering the prohibited weapon to the Commissioner of
may be fixed by the Commissioner with the approval of the Minister, to any police station or other place nominated by the Commissioner for the purpose;

(b)

selling or otherwise giving possession of the prohibited weapon to a person who is authorised to possess it by a permit under the Act or who is authorised to buy or take possession of it by a permit under the Firearms Act 1989;

(c)

proceeding to a police station or other nominated place for the purpose of surrendering the prohibited weapon as referred to in paragraph (a) or proceeding to a place for the purpose of selling or otherwise giving possession of the prohibited weapon as referred to in paragraph (b).

(3) This clause ceases to operate at the end of 30 June 1995.

EXPLANATORY NOTE

The object of this Regulation is to provide for an amnesty for the surrender of firearms that are prohibited weapons. The amnesty authorises the possession of such a prohibited weapon but only for the purpose of enabling it to be surrendered to Police or sold (or otherwise disposed of) to a person who is authorised by the appropriate permit to take possession of it. The amnesty ceases on 1 July 1995.

This Regulation is made under section 5 (1) of the Prohibited Weapons Act 1989.
