His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Prohibited Weapons Act 1989.

Explanatory note

Clause 13 of the Prohibited Weapons Regulation 1990 authorises possession (but not the use) of a prohibited weapon but only for the purpose of surrendering the weapon to the Commissioner of Police. In the case of a prohibited weapon that is a firearm, clause 13 also authorises possession of the firearm for the purposes of selling it to a licensed firearms dealer. The period of this temporary amnesty for surrendering (and selling) prohibited weapons expired on 30 June 1996.

The object of this Regulation is to restore this amnesty provision and extend the amnesty period until such time as the proposed 12 month amnesty provision for surrendering prohibited firearms under the new Firearms Act 1996 commences. However, the extension of the expired amnesty will not result in authorising the selling of self-loading centre-fire or rimfire rifles, or self-loading or pump action shotguns, to firearms dealers. This is consistent with the recent amendment to the Firearms Regulation 1990 which prohibited the sale of such firearms.

This Regulation is made under the Prohibited Weapons Act 1989, including

sections 5 (1) and 20 (the general regulation making power).

1 Name of Regulation

This Regulation is the Prohibited Weapons Amendment
(Amnesty) Regulation 1996.

  1. Amendment of Prohibited Weapons Regulation 1990

    The Prohibited Weapons Regulation 1990 is amended as set out

    in Schedule 1.

The explanatory note does not form part of this Regulation.

[1]        Clause 13 Temporary amnesty for surrender of prohibited weapons

Omit clause 13 (2) and (3).

[2]        Clause 13 (4)

Omit “at the end of 30 June 1996”.
Insert instead “on the day on which clause 3 of Schedule 3 to the
Firearms Act 1996 commences”.

[ 3 ]       Clause 14 Person who previously held shooter licence not required to pass permit test during amnesty

Omit the clause.
