Editorial amendments
The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication. Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.
This republication does not include amendments made under part 11.3 (see endnote 1).
Uncommenced provisions and amendments

This regulation is the Professional Engineers Regulation 2024.

Registration conditions—Act, s 24 (1) (b)
(1)It is a condition of a professional engineer’s registration that the engineer not undertake work in the building and construction industry unless—
(a)the engineer gives the registrar a report from an assessment entity that assesses the engineer’s qualifications, experience and competencies to undertake work in the building and construction industry; and
(b)the registrar is satisfied that the engineer has the required qualifications, experiences and competencies to undertake work in the building and construction industry.
NoteA professional engineer may apply to the registrar for a variation of the engineer’s registration (see Act, s 28).
(2)In this section:
building work—
(a)has the same meaning as in the Building Act 2004, section 6; but
(b)does not include the disposal of waste materials generated by an alteration or demolition mentioned in that Act, section 6 (1) (a) or (b).
work, in the building and construction industry, means a professional engineering service for an area of engineering that relates to building work.
Registration term—registration period for additional area of engineering—Act, s 25 (b) (ii)
(1)This section applies if—
(a)a professional engineer is registered for an area of engineering (the first registration); and
(b)before, on or after the day the first registration commences, the registrar decides to register the individual for an additional area of engineering (the additional registration).
(2)The period worked out under subsection (3) is prescribed for the additional registration.
(3)The professional engineer’s additional registration ends on the day their first registration ends.
Registration term—applications for registration decided before commencement day—Act, s 25 (b) (ii)
(1)This section applies if—
(a)before the commencement day, the registrar decides to register an individual for an area of engineering; and
(b)section 5 does not apply.
(2)The period worked out under subsection (3) is prescribed.
(3)The individual’s registration ends 3 years after the day the registrar decides to register the individual.
(4)This section expires 3 years after the commencement day.
(5)In this section:
commencement day means the day the Act, section 22 (Deciding applications) commences.
