Proclamation under the Roads and Jetties Act 1935

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, by this my proclamation made under section 7 of the Roads and Jetties Act 1935 –

(a) declare that the portion of road specified in Schedule 1 to this proclamation ceases to be a State highway for the purposes of Part II of that Act; and (b) declare that the portion of road specified in Schedule 2 to this proclamation ceases to be a subsidiary road for the purposes of Part II of that Act; and (c) declare the roads and portions of roads specified in Schedule 3 to this proclamation to be a subsidiary road, and classified as a developmental road, for the purposes of Part II of that Act; and (d) amend the proclamation notified in the Gazette as Statutory Rules 1970, No. 67 as follows: (i) by omitting from the First Schedule to that proclamation the item relating to the Lyell Highway and substituting the following item:

Lyell Highway From its junction with the Brooker Highway at Granton to its junction with Harvey Street (Macquarie Heads Developmental Road) at Strahan, (via New Norfolk, Gretna, Ouse, Derwent Bridge and Queenstown) 174.86 (281.41 kilometres)

(ii) by omitting from Part I of the Second Schedule to that proclamation the item relating to the Henty Main Road and substituting the following item:

Henty Main Road From its junction with the roundabout at the junction of Andrew Street and Harvey Street (Macquarie Heads Developmental Road) at Strahan to its junction with the Zeehan Highway at Zeehan 26.06 (41.94 kilometres)

(iii) by inserting into Part IV of the Second Schedule to that proclamation, in the correct alphabetical position, the following item:

Macquarie Heads Developmental Road From the junction of Reid Street (Lyell Highway) and Harvey Street, Strahan, to the junction of Macquarie Heads Road and the access road to Smith Cove, Strahan, via Harvey Street, Ocean Beach Road and Macquarie Heads Road, including the roundabout at the junction of Andrew Street and Harvey Street 3.23 (5.19 kilometres)

(e) revoke the proclamation notified in the Gazette as Statutory Rules 1993, No.212; and (f) revoke the proclamation notified in the Gazette as Statutory Rules 1992, No.139, to the extent that it relates to the Henty Main Road; and (g) declare that this proclamation takes effect on the day on which its making is notified in the Gazette.

EXPLANATORY NOTE

(This note is not part of the proclamation) This proclamation –

(a) declares that a portion of the Lyell Highway ceases to be a State highway; and (b) declares that a portion of the Henty Main Road ceases to be a subsidiary road; and (c) declares a new subsidiary road, classified as a developmental road (Macquarie Heads Developmental Road); and (d) revokes all, or part, of certain amending proclamations.
