Proclamation under the Nature Conservation Act 2002

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, by this my proclamation made under sections 11(2) and 19(1) of the Nature Conservation Act 2002  –

(a) declare so much of the Crown land specified in Part 1 of Schedule 1 to this proclamation that is not already a conservation area to be reserved land in the class of conservation area; and (b) give the name Forsyth Island Conservation Area to the land specified in Part 1 of Schedule 1 to this proclamation; and (c) declare so much of the Crown land specified in Part 2 of Schedule 1 to this proclamation that is not already a conservation area to be reserved land in the class of conservation area; and (d) give the name Storehouse Island Conservation Area to the land specified in Part 2 of Schedule 1 to this proclamation; and (e) declare that this proclamation takes effect on the day on which its making is notified in the Gazette.

EXPLANATORY NOTE

(This note is not part of the proclamation) This proclamation –

(a) amends the Forsyth Island Conservation Area and the Storehouse Island Conservation Area by extending the conservation areas to the low-water mark; and (b) names those conservation areas in accordance with the Nature Conservation Act 2002.The conservation area at Storehouse Island was proclaimed as a sanctuary under the Crown Lands Act 1911, and the conservation area at Forsyth Island was proclaimed as a sanctuary under the Crown Lands Act 1903 and continued under the Crown Lands Act 1911. These sanctuaries then – (a) came within the definition of a Crown reserve in the Animals and Birds Protection Act 1928; and (b) were converted to conservation areas under the National Parks and Wildlife Act 1970 by clause 1 of Part 1 of Schedule 2 to that Act; and (c) were continued as conservation areas under the Nature Conservation Act 2002 by clause 2 of Schedule 4 to that Act.
