under the
Transport Legislation Amendment (Waterfall Rail Inquiry
Recommendations) Act 2005
MARIE BASHIR, Governor I, Professor Marie Bashir AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Transport Legislation Amendment (Waterfall Rail Inquiry Recommendations) Act 2005, do, by this my Proclamation, appoint 1 July 2005 as the day on which all uncommenced provisions of that Act (other than Schedule 2 [32] and [58]) commence.

| Explanatory note |
The object of this Proclamation is to commence all uncommenced provisions of the Transport Legislation Amendment (Waterfall Rail Inquiry Recommendations) Act 2005 on 1 July 2005 other than provisions substituting section 64 of the Rail Safety Act 2002 and repealing Schedule 3 to that Act. The new section 64 will enable the regulations to prescribe occurrences that must be reported to the Chief Investigator by an accredited railway operator, such occurrences are currently set out in Schedule 3 to the Rail Safety Act 2002.
