Building Legislation Amendment (Quality of Construction) Act

2002 No 134

MARIE BASHIR, Governor

I, Professor Marie Bashir AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Building Legislation Amendment (Quality of Construction) Act 2002, do, by this my Proclamation, appoint 1 February 2003 as the day on which that Act commences, except for the following provisions:

(a) Schedule 1.1 [6]–[30], [32], [33], [36] and [41],
(b) Schedule 1.2 [1]–[26],
(c) Schedule 1.3,
(d) Schedule 2.1 and 2.2,
(e) Schedule 3.

Explanatory note
Explanatory note

The object of this Proclamation is to commence such of the provisions of the Building Legislation Amendment (Quality of Construction) Act 2002 as relate to the following matters:

(a)

the status and functions of certain committees established under the Environmental Planning and Assessment Act 1979,

(b)

the subdelegation of certain functions delegated to the Director-General of the Department of Planning under the Environmental Planning and Assessment Act 1979,

(c)

the powers of entry exercisable by a principal certifying authority under section 118A of the Environmental Planning and Assessment Act 1979,

(d)

the persons by whom penalty notices may be issued under section 127A of the Environmental Planning and Assessment Act 1979,

(e)

the penalties payable with respect to certain offences when dealt with by way of penalty notice under the Environmental Planning and Assessment Act 1979,

(f)

the exclusion of personal liability with respect to certain acts and omissions occurring in the course of the execution of the Environmental Planning and Assessment Act 1979,

(g)

savings and transitional provisions in relation to certain amendments made to the Environmental Planning and Assessment Act 1979,

(h)

minor law revision with respect to the Environmental Planning and Assessment Act 1979.
