under the

Fisheries Management Act 1994

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and on the recommendation of the Minister for Primary Industries, and in pursuance of section 42 (2) of the Fisheries Management Act 1994, do, by this my Proclamation, amend Schedule 1 to the Act, with effect on 22 September 2006, as set out in the Schedule 1 to this Proclamation.

Explanatory note

Schedule 1 to the Fisheries Management Act 1994 specifies share management fisheries for the purposes of that Act. The object of this Proclamation is to amend that Schedule to redefine the estuary prawn trawl and estuary general share management fisheries. The effects of the redefinition are:

(a) to exclude the waters of Port Jackson from both fisheries, and

(b)

to clarify that fishing activities in Jervis Bay that fall within the description of the ocean hauling share management fishery do not form part of the estuary general fishery.

Schedule 1 Share Management Fisheries

Omit the descriptions of the estuary general fishery and the estuary prawn trawl fishery (clauses 6D and 6E).

Insert instead:

6D Estuary general fishery
Description of fishery
(1) The estuary general fishery consists of:

(a)

the taking of fish from estuarine waters by any lawful method other than by use of an otter trawl net (prawns), and

(b)

the taking of fish from ocean beaches by the method of hand picking.

(2) In this clause, estuarine waters do not include the following:
(a) the waters of Port Jackson (including Sydney Harbour),

(b)

the waters of Jervis Bay, in relation to any fishing method that, when used in those waters, falls within the description of the ocean hauling fishery.

6E Estuary prawn trawl fishery
Description of fishery
(1) The estuary prawn trawl fishery consists of the use of an otter
trawl net (prawns) to take fish from estuarine waters.
(2) In this clause, estuarine waters do not include the waters of Port
Jackson (including Sydney Harbour).
