Proceeds of Crime Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Proceeds of Crime Act 1987.

1.   Amendment

1.1   The Proceeds of Crime Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3 (Declaration of State laws—definition of “corresponding law”)

2.1   Paragraph 3 (a):

Omit the paragraph.

2.2   After paragraph 3 (f), insert:

  • “(fa)

    Crime (Confiscation of Profits) Act 1993 of Tasmania;”.

3.   Regulation 4 (Declaration of orders—definition of “interstate forfeiture order”)

3.1   Paragraph 4 (a):

Omit the paragraph.

3.2   After paragraph 4 (f), insert:

  • “(fa)

    forfeiture orders under section 16 of the Crime (Confiscation of Profits) Act 1993 of Tasmania;”.

4. Regulation 5 (Declaration of orders—definition of “interstate pecuniary penalty

order”)

4.1   Paragraph 5 (a):

Omit the paragraph.

4.2   After paragraph 5 (e), insert:

  • “(ea)

    pecuniary penalty orders under section 21 of the Crime (Confiscation of Profits) Act 1993 of Tasmania;”.

5.   Regulation 6 (Declaration of orders—definition of “interstate restraining order”)

5.1   Paragraph 6 (a):

Omit the paragraph.

5.2   After paragraph 6 (f), insert;

  • “(fa)

    restraining orders under section 26 of the Crime (Confiscation of Profits) Act 1993 of Tasmania;”.

6.   Regulation 16 (Law enforcement projects—prescribed law enforcement agencies)

6.1   Add at the end:

  • “; (i)

    the Trade Practices Commission.”.
