Proceeds of Crime Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Proceeds of Crime Act 1987.

1.   Amendment

1.1   The Proceeds of Crime Regulations are amended as set out in these Regulations.

[Note:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3 (Declaration of State laws—definition of “corresponding law”)

2.1   Paragraph 3 (e):

Omit the paragraph, substitute:

  • “(e)

    Criminal Assets Confiscation Act 1996 of South Australia;”.

3.   Regulation 4 (Declaration of orders—definition of “interstate forfeiture order”)

3.1   Paragraph 4 (e):

Omit the paragraph, substitute:

  • “(e)

    forfeiture orders made under section 8 or 9 of the Criminal Assets Confiscation Act 1996 of South Australia;”.

4.   Regulation 5 (Declaration of order—definition of “interstate pecuniary penalty order”)

4.1   New paragraph 5 (da):

After paragraph 5 (d), insert:

  • “(da)

    pecuniary penalty orders under paragraph 9 (4) (b) of the Criminal Assets Confiscation Act 1996 of South Australia;”.

5.   Regulation 6 (Declaration of orders—definition of “interstate restraining order”)

5.1   Paragraph 6 (e):

Omit the paragraph, substitute:

  • “(e)

    restraining orders under section 15 of the Criminal Assets Confiscation Act 1996 of South Australia;”.
