Private Hospitals and Day Procedure Centres Act 1988

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Private Hospitals and Day Procedure Centres Act 1988.

Explanatory note
The object of this Regulation is:

(a) to amend the Private Hospitals Regulation 1996:

(i)

to increase the annual licence fee and the fees for an application for a licence or an application to transfer a licence, and

(ii)

to require information in respect of nursing staff at a private hospital to be provided with the annual licence fee, and

(iii)

to update the requirements in relation to hot and warm water systems at private hospitals so that the requirements are consistent with the requirements under the Public Health Act 1991 for those systems, and

(b) to amend the Day Procedure Centres Regulation 1996:

(i)

to increase the annual licence fee and the fees for an application for a licence or an application to transfer a licence, and

(ii)

to require information in respect of nursing staff at a day procedure centre to be provided with the annual licence fee, and

Explanatory note

(iii)   to include requirements in relation to hot and warm water systems at day procedure centres that are consistent with the requirements under the Public Health Act 1991 for those systems.

This Regulation is made under the Private Hospitals and Day Procedure Centres
Act 1988, including section 55 (the general regulation-making power).

  1. Name of Regulation

    This Regulation is the Private Hospitals and Day Procedure Centres
    Amendment (Fees and Other Matters) Regulation 2001.

  2. Amendment of Private Hospitals Regulation 1996

    The Private Hospitals Regulation 1996 is amended as set out in
    Schedule 1.

  3. Amendment of Day Procedure Centres Regulation 1996

    The Day Procedure Centres Regulation 1996 is amended as set out in
    Schedule 2.

    Insert at the end of clause 20 (1) (b):

(c) information in the approved form in respect of the nursing staff at the private hospital.
  1. Schedule 1 Licensing standards for all private hospitals

    Omit clause 3 (2) of Schedule 1. Insert instead:

    (2) Any hot or warm water system supplying those areas of a private hospital that are used by patients for accommodation, ablutions, recreation or dining must be a system that has been installed in accordance with the prescribed installation requirements under section 45 of the Public Health Act 1991.

  2. Schedule 1, clause 12

    Omit clause 12 (2) (a). Insert instead:

(a) all hot and warm water systems, and
