The Parliament of Australia enacts:
This Act may be cited as the
Private Health Insurance Legislation Amendment Act 2009 .
(1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this Act as originally passed by both Houses of the Parliament and assented to. It will not be expanded to deal with provisions inserted in this Act after assent.
(2) Column 3 of the table contains additional information that is not part of this Act. Information in this column may be added to or edited in any published version of this Act.
Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
1 Schedule 2 (cell at table item 9A, column headed “Provision(s)”) Omit “and Part 2‑3”, substitute “, Part 2‑3 and subsection 63‑5(4)”.
After “(lifetime health cover)”, insert “or subsection 63‑5(4)”.
Add:
(4) A premium payable for a policy that covers an insured group of 2 or more people that includes a *dependent child non‑student may be higher than a premium payable for a policy in the same *product that covers an insured group of 2 or more people that includes one or more *dependent children but no dependent child non‑student.
(5) A
dependent child non‑student is a *dependent child who:
(a) is aged between 18 and 24 (inclusive); and
(b) is not receiving full‑time education at a school, college or university.
Add:
; (e) levy imposed under the
Private Health Insurance (National Joint Replacement Register Levy) Act 2009 (national joint replacement register levy ).
Omit “and”, substitute “or”.
Add:
(v) *national joint replacement register levy imposed on a supplementary national joint replacement register levy day (within the meaning of the
Private Health Insurance (National Joint Replacement Register Levy) Act 2009 ); and
Omit “private health insurer”, substitute “person”.
Omit “the insurer”, substitute “the person”.
Add:
; (c) a *national joint replacement register levy;
(d) a late payment penalty in respect of a national joint replacement register levy.
Omit “of *complaints levy,”, substitute:
