Private Health Insurance Incentives Act 1998 . Dated 4 February 1999.

These regulations commence on gazettal.
Schedule 1 amends the
Private Health Insurance Incentives Regulations 1998 .
(regulation 3)
[1] Regulation 3, definition of Government’s 30% rebate
substitute
Federal Government 30% Rebate on private health insurance , in relation to an appropriate private health insurance policy, means:
(a) the incentive payments scheme for an amount of premium paid under the policy; or
(b) the premiums reduction scheme for a premium payable under the policy; or
(c) the private health insurance tax offset.
insert before definition of Act
30% Rebate logo means the logo described in regulation 7.
substitute
(c) the health fund must have used the phrase ‘Federal Government 30% Rebate on private health insurance’ or the 30% Rebate logo in:
(i) advertisements, in the relevant period, for the Federal Government 30% Rebate on private health insurance; and
(ii) notices under paragraph (b); and
(iii) forms that were given to persons in the relevant period in relation to the premiums reduction scheme.

(b) if a premium under an appropriate private health insurance policy is increased during the relevant period but after the date of the application, the health fund will:
(i) give to each participant affected by the increase written notice of the matters mentioned in subparagraphs (2) (b) (i), (ii) and (iii) in relation to that increase; and
(ii) use the phrase ‘Federal Government 30% Rebate on private health insurance’ or the 30% Rebate logo in that notice.

(aa) if the health fund was a participating fund in the financial year beginning on 1 July 1999 — the health fund:
(i) on or before 15 July 2000, gave to each participant the written statement mentioned in paragraph 4 (3) (a); and
(ii) gave, to all participants affected by each increase in premium mentioned in paragraph 4 (3) (b), written notice of the increase with the phrase ‘Federal Government 30% Rebate on private health insurance’ or the 30% Rebate logo; and
(ab) if the health fund was a participating fund in the previous financial year (other than the financial year beginning on 1 July 1999) — the health fund:
(i) on or before 15 July of that previous financial year, gave to each participant the written statement mentioned in paragraph (3) (a); and
(ii) gave, to all participants affected by each increase in premium mentioned in paragraph (3) (b), written notice of the increase with the phrase ‘Federal Government 30% Rebate on private health insurance’ or the 30% Rebate logo; and

(c) the health fund must have used the phrase ‘Federal Government 30% Rebate on private health insurance’ or the 30% Rebate logo in:
(i) advertisements, in the previous financial year, for the Federal Government 30% Rebate on private health insurance; and
(ii) notices under paragraph (b); and
(iii) forms that were given to persons in the previous financial year in relation to the premiums reduction scheme.

(b) if a premium under an appropriate private health insurance policy is increased during the previous financial year but after the date of the application, the health fund will:
(i) give to each participant affected by the increase written notice of the matters mentioned in subparagraphs (2) (b) (i), (ii) and (iii) in relation to that increase; and
(ii) use the phrase ‘Federal Government 30% Rebate on private health insurance’ or the 30% Rebate logo in that notice.

insert Federal Government 30% Rebate on private health insurance;
substitute
(c) must use the phrase ‘Federal Government 30% Rebate on private health insurance’ or the 30% Rebate logo; and
(d) must be given to the participant on or before 15 July immediately following the financial year to which it relates.

7 30% Rebate logo
(1) The logo for the Federal Government 30% Rebate on private health insurance is:
(2) In any reproduction of the logo:
(a) the portions other than the shaded areas of the umbrella must be black and white, as shown in subregulation (1); and
(b) the shaded areas of the umbrella must be:
(i) in the case of monochrome reproduction —60% black; and
(ii) in any other case — red (PMS 032).
