I, PETER WOODLEY, delegate of the Minister for Health and Ageing, make these Rules under item 6 of the table in section 333-20 of the Private Health Insurance Act 2007.

Part 1Preliminary

1.

Name of Rules

These Rules are the Private Health Insurance (Health Insurance Business) Amendment Rules 2011 (No. 1).

2.Commencement

These Rules commence on:

(a) 1 July 2011; or

(b) if registered after 1 July 2011, the day after registration.

3.Amendment of the Private Health Insurance (Health Insurance Business) Rules 2010

The Schedule amends the Private Health Insurance (Health Insurance Business) Rules 2010.

Schedule – Amendments

[1]Part 2, subrule 4(2)

Delete subrule 4(2) and insert:

(2) In this rule, HCP Data from Hospitals to Insurers means the protocol set out in the document approved by the Acting Assistant Secretary of the Private Health Insurance Branch of the Department of Health and Ageing on 8 March 2011 which consists of “Data Specifications (HCP)” and “Explanatory Notes (HCP)”, and sets out the data specifications for data provided by hospitals to private health insurers.

[2]Part 2, subrule 7(3)

Delete subrule 7(3) and insert:

(3) In this rule, PHDB Data from Private Hospitals to the Department means the protocol set out in the document approved by the Acting Assistant Secretary of the Private Health Insurance Branch of the Department of Health and Ageing on 8 March 2011 which consists of “Data Specifications (PHDB)” and “Explanatory Notes (PHDB)”, and sets out the data specifications for data provided by private hospitals to the Department.
