I, ANTHONY JOHN ABBOTT, Minister for Health and Ageing, make these Rules under item 12 of the table in section 333-20 of the

These Rules are the
Private Health Insurance (Council) Rules 2007 .
These Rules commence:
(a) if the Rules are registered before the Act commences―at the same time as the Act commences; or
(b) if the Rules are registered on or after the day on which the Act commences―on the date on which the Rules are registered,
whichever occurs first.
Note: Terms used in these Rules have the same meaning as in the Act―see section 13 of the
Legislative Instruments Act 2003 . These terms include:Commissioner

In these Rules:
Act means thePrivate Health Insurance Act 2007 .
Remuneration Tribunal means the tribunal established under section 4 of theRemuneration Tribunal Act 1973 .
(1) For paragraph 264-10 (5) (a) of the Act, the Council may make available to the public statistics and other benefit information provided to it in returns lodged by private health insurers under section 310-1 of the Act.
(2) Information that is made available under subrule (1) must be in aggregate form, so as not to identify individual private health insurers.
(3) In this rule,
make available to the public means to publish, provide to a person upon request or to publicise in any way.
For paragraph 270-1 (b) of the Act:
(a) the Commissioner; and
(b) members of the Council, including the Deputy Commissioner,
are to be appointed for terms not exceeding three years, but are eligible for reappointment.
