Part 1Preliminary

1Name of Rules

These Rules are the Private Health Insurance (Complaints Levy) Amendment Rules 2015.

2Commencement

  1. These Rules commence on the day after they are registered.

3Authority

These Rules are made under the Private Health Insurance (Complaints Levy) Act 1995.

4Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1 – Amendments

Private Health Insurance (Complaints Levy) Rules 2007

1Rule 4

Repeal the rule, substitute:

4.Imposition of levy

For the purposes of paragraph 5 (1) (a) of the Act, each of the following days is specified as a complaints levy day:

(a) 30 November 2015; and

(b) for the financial year commencing on 1 July 2016 and every financial year thereafter, the first day of October.

2Rule 5 (note)

Omit “Private Health Insurance Administration Council”, substitute “Australian Prudential Regulation Authority”.

3Subrule 6(1)

Repeal the subrule, substitute:

(1) Subject to subrule (2), the rate for a single policy is the rate in cents calculated using the formula:

(a) for the complaints levy day specified in paragraph 4 (a) –

69,566,667

single coverage policies + (2 x joint coverage policies)

(b) for the complaints levy day specified in paragraph 4 (b) –

139,133,334

single coverage policies + (2 x joint coverage policies)

where:

single coverage policies is the aggregate number of single policies on issue from all private health insurers on the census day.

joint coverage policies is the aggregate number of all joint policies on issue from all private health insurers on the census day.

4Subrule 7(1)

Repeal the subrule, substitute:

(1) Subject to subrule (2), the rate for a joint policy is the rate in cents calculated using the formula:

(a) for the complaints levy day specified in paragraph 4 (a) –

2 x

69,566,667

single coverage policies + (2 x joint coverage policies)

(b) for the complaints levy day specified in paragraph 4 (b) –

2 x

139,133,334

single coverage policies + (2 x joint coverage policies)

where single coverage policies and joint coverage policies have the same meaning as in subrule 6(1).

5Rule 8 (note)

Omit “2007”, substitute “2015”.

6After rule 8

Insert:

9.Levy imposed before the Private Health Insurance (Complaints Levy) Amendment Rules 2015

(1) Despite the amendments made by the amending rules, these Rules as in force immediately before the amending rules commenced continue to apply in relation to levy imposed before that time.

(2) In this rule, amending rules means the Private Health Insurance (Complaints Levy) Amendment Rules 2015.
