Regulation under the Private Health Facilities Act 2007.

Explanatory note

The object of this Regulation is to enable revision rhinoplasties to be performed at an unlicensed private health facility by excluding revision rhinoplasties from the definition of cosmetic surgery under the Private

Health Facilities Regulation 2017. That Regulation prescribes cosmetic surgery as a service or treatment
that must not be performed at an unlicensed private health facility.

A revision rhinoplasty is defined as a minor rhinoplasty performed on a patient at least 12 months after an initial rhinoplasty on the patient has been performed.

This Regulation is made under the Private Health Facilities Act 2007, including sections 33A and 65
(general regulation-making power).

1      Name of Regulation

This Regulation is the Private Health Facilities Amendment (Cosmetic Surgery)

Regulation 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendments of Private Health Facilities Regulation 2017

(1) Clause 3 Definitions

Insert “(other than revision rhinoplasty)” after “rhinoplasty” in paragraph (b)(xiv) of the definition of cosmetic surgery in clause 3(1).

(2) Clause 3(1)
Insert in alphabetical order—

revision rhinoplasty means a rhinoplasty performed on a patient at least
12 months after an initial rhinoplasty is performed on the patient, and

where each of the following circumstances applies—

(a) the procedure requires only a local anaesthetic to be administered,
(b) the procedure does not involve any bony structures or turbinates,
(c) if a nasal airway is obstructed, it must only be a minor obstruction that can be corrected by the removal of mucous membrane or cartilage,
(d) the patient has an adequate amount of skin available to perform the procedure.
