  1. Name of Regulations

These Regulations are the Privacy (Private Sector) Amendment Regulations 2005 (No. 1).

  1. Commencement

These Regulations commence on the day after they are registered.

  1. Amendment of Privacy (Private Sector) Regulations 2001

Schedule 1 amends the Privacy (Private Sector) Regulations 2001.

Centrelink means the Commonwealth Services Delivery Agency established by subsection 6 (1) of the Commonwealth Services Delivery Agency Act 1997.

  1. Exceptions to National Privacy Principle 7.2 — Centrelink Confirmation eServices

For paragraph 7.2 (c) of the National Privacy Principles:

(a)an organisation specified in Schedule 3 is a prescribed organisation; and

(b)the Customer Reference Number assigned to an individual by Centrelink is a prescribed identifier; and

(c)the prescribed circumstance is that the Customer Reference Number is used or disclosed by a prescribed organisation, with the consent of the individual concerned, to access Centrelink Confirmation eServices for the purpose of making a Customer Confirmation enquiry to determine whether the individual is entitled to receive a concession.
