AN ACT to amend the Prisons Act 1981.

[Assented to 6 October 1982.1

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Prisons glfIrgiaVieon.

In this Act the Prisons Act 1981 is referred itirES:115

to as the principal Act.

(3)

The principal Act as amended by this Act may

be cited as the Prisons Act 1981-1982.

Section 6

amended.

2. Section 6 of the principal Act is amended

(a)

in subsection (2), by deleting "be Acting" and substituting the following-

" act as " ; and

(b)

by inserting after subsection (4) the follow- ing subsection

(5) The Minister may for the purposes of this Act engage persons as employees and, subject to any indus- trial award or agreement that is applicable in relation to a particular case or class of cases, persons so engaged shall be employed on such terms and conditions as the Minister, on the recommendation of the Public Service Board, determines. " .

Section 42

amended.

3. Section 42 of the principal Act is amended in paragraph (c) of subsection (1) by inserting after "prison" the following-

" or during his temporary absence from a

prison " .

Section 110

amended.

4. Section 110 of the principal Act is amended in paragraph (e) of subsection (1) by deleting "prison".
