AN ACT to amend section seventy-four of the

Prisons Act, 1903-1978.

[Assented to 7th November, 1979.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

Short title

1. (1) This Act may be cited as the Prisons Act

and

Amendment Act, 1979.

Section 74

amended.

2. Section 74 of the principal Act is amended

(a)

by deleting the passage commencing with the word "under" in line three and ending with the word "prisoner" in line eight and substituting the passage ", may fire upon any prisoner who is attempting to escape from any prison or other place, or who is assaulting or attempting to assault any ,person"; and

(b) as to the proviso-

(i)    by adding after the word "assault" in line three the words "that is being";

(ii)    by deleting the word "was" in line four and substituting the word "is"; and

(iii)    by adding after the word "person" in the penultimate line the words "who is being".
