Prisoners (Interstate Transfer) Act 1983

Prisoners (Interstate Transfer) Amendment

Regulations 2008

Made by the Governor in Executive Council.

1.           Citation

These regulations are the Prisoners (Interstate Transfer)
Amendment Regulations 2008.

2.            Commencement

These regulations come into operation as follows:

(a)	regulations 1 and 2— on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.            The regulations amended

The amendments in these regulations are to the Prisoners
(Interstate Transfer) Regulations 1984.

4.            Regulation 4 amended

Regulation 4(1) is amended by deleting the definitions of "non-parole period", "Parole Board", "parole officer" and "probation period" and inserting instead

Act 2003 section 7(1)

"Department of the Attorney General" means the

department principally assisting the Attorney by the Attorney General.

5.            Regulation 5 amended

Regulation 5(3)(a) is amended as follows:

(a)	by deleting "probation or";
(b)	after "period" by inserting

6.            Regulation 11 amended

Regulation ills amended by deleting paragraph (a) and inserting instead -

(a) the Prisoners Review Board established under

the Sentence Administration Act 2003;

7.            Regulation 14 amended

Regulation 14(2) is amended by deleting "Under Secretary for
Law, Crown Law Department." and inserting instead -

"

chief executive officer of the Department of the
Attorney General.

8.          Schedule I amended

(1) Schedule I is amended by deleting from "Schedule 1" to

"[Reg. s.5(1)]" and inserting instead -

(2) Schedule 1 Form 4 is amended as follows:

(a) by deleting "Under Secretary for Law, Crown Law Department," and inserting instead -

by deleting "Under Secretary for Law," in the second " Chief Executive Officer, ";

(c) by deleting "Crown Law Department." in the second place where it occurs and inserting instead -

and inserting instead -

(4) Schedule 1 Form 6 is amended by deleting "a Stipendiary

Magistrate constituting a" and inserting instead -

(5) Schedule I Form 7 is amended as follows:

(a) by deleting "Local Court" and inserting instead -

" Magistrates Court ";

(b) by deleting "Stipendiary" in each place where it occurs.

9.	Various references to "Court of Petty Sessions" changed to "Magistrates Court"
(1)	Each provision listed in the Table to this subregulation is amended by deleting "a court of petty sessions" in each place where it occurs and inserting instead -
