His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Prisoners (Interstate Transfer) Act 1982.

Explanatory note
Section 13 (2) of the Prisoners (Interstate Transfer) Act 1982 provides for a certificate signed by a prescribed officer to be proof (in the absence of evidence to the contrary) that the consents or requests required to be given for the transfer of a prisoner to a participating State or Territory have been given or made.
The object of this Regulation is to amend the Prisoners (Interstate Transfer) Regulation 1994 to prescribe the Director, Community Relations Division, Attorney General’s Department as an additional prescribed officer for the purposes of section 13 (2).
This Regulation is made under the Prisoners (Interstate Transfer) Act 1982, including section 13 (2).

1 Name of Regulation
This Regulation is the Prisoners (Interstate Transfer) Amendment
Regulation 1997.
Amendment of Prisoners (Interstate Transfer) Regulation 1994
The Prisoners (Interstate Transfer) Regulation 1994 is amended as set out in Schedule 1.

Omit clause 12 (2). Insert instead:

The following are prescribed officers for the purpose of signing a certificate referred to in section 13 (2) of the Act:
(a)
the Director-General of the Attorney General’s Department,
(b)
the Director, Community Relations Division, Attorney General’s Department.
