[A ssented to 22 nd O ctober , 1953.] B E it enacted by the Queen’s Most Excellent Majesty, by and with tbe advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by tbe authority of the same, as follows:— P art I. —P reliminary . P art I.— P reliminary . 1. (1.) This Act may be cited as “ The Printers short title. and Newspapers Act of 1953.” *(2.) Except as herein otherwise provided, this Act Commence- shall come into operation on a date to be fixed by the “ct^ °f thw Governor in Council by Proclamation published in the Gazette. 2. This Act, including every Proclamation and ^f°“t™ction regulation made hereunder, shall be read and construed ’ so as not to exceed the legislative power of the State to the intent that, where any enactment hereof or provision of any such Proclamation or regulation would but for jbhis section have been construed as being in excess of that power, it shall nevertheless be a valid enactment or provision to the extent to which it is not in excess of that power. 3. This Act is divided into Parts as follows :— P art I. —P reliminary ; P art II.— A dministration ; P art III. —P rinting P resses ; P art IV. —I mprinting ;* * Commenced 21 Dec. 1953 (Proc. pubd. No. 20 and Savings. 4.*“ The Printers and Newspapers Act of 1914 ” (herein referred to as “ the repealed Act ”), is hereby repealed : Provided that, but without limiting the operation of f“ The Acts Shortening Acts ”— (i.) Unless otherwise expressly provided, every regulation, register, registration, affidavit, declaration, notice, certificate, record, instrument and act of authority made, kept, given, issued, or otherwise originated under the repealed Act and subsisting at the commencement of this Act, shall, subject as hereinafter provided and so far as it is consistent with this Act, continue for the purposes of this Act in force (until it expires by effluxion of time, or is repealed, amended or otherwise modified, revoked, cancelled or surrendered under this Act) as fully and effectually as if it had originated under the corresponding provisions of this Act, and shall, where necessary, be deemed to have so originated : Provided that every such regulation, register, registration, affidavit, declaration, notice, certificate, record, instrument, and act of authority shall be read and construed subject to this Act; (ii.) All penalties and forfeitures imposed under any provision of the repealed Act and incurred at the repeal of that Act shall be enforceable and may be enforced as if the repealed Act had not been repealed; (iii.) All actions and proceedings under the repealed Act commenced or pending when that Act is repealed may be carried on and prosecuted as if such repeal had not been made, and no such action or proceeding shall abate or be discontinued or prejudicially affected by anything contained in this Act; and * 5 G. 5 No. 20. f 31 V. In any Act (including any regulation or other instrument thereunder) any reference to or citation of the repealed Act shall be deemed, unless the context otherwise indicates or requires, to be a reference to or citation of this Act. 5. (1.) In this Act, unless the context otherwise Meaning of indicates or requires, the following terms shall have theterms- meanings respectively assigned to them, that is to say— “ At ”—Used in relation to the term “ place ” At. includes in that place and upon that place ; “ Company ”—Any body corporate, incorporated Company, whether in Queensland or elsewhere: Without limiting the generality of the aforegoing, the term includes any society within the meaning of *“ The Co-operative Societies Acts, 1946 to 1951 ” ; “ Director ”—Includes a member of the committee Director, of management of a society within the meaning of *“ The Co-operative Societies Acts, 1946 to 1951 ” ; Distribute”—Includes circulate or deliver Distribute, (whether gratuitously or for money, or publicly or privately), or leave in any public place or expose in any way to public view ; Inspector ”—The Chief Inspector or any other inspector, inspector appointed under this Act, or any person who pursuant to this Act is an inspector or who is appointed for the time being to act as an inspector ; Keep ”—Includes (whether jointly or severally) Keep, own, be beneficially interested in, have any power of disposition over, and have in possession or under control, whether for the use or benefit of the person of whom the term is used or of another person, and although another person has the actual possession or custody of the thing in question ; “ Minister ’’-■—The Attorney-General or other Minister. No. 8, "Newspaper "—Includes any paper or pamphlet containing any public news, intelligence, or occurrences, or any remarks or observations therein or upon any political matter, printed for sale or distribution, and published periodically or in parts or numbers at intervals not exceeding thirty-one days between the publication of any two such papers or pamphlets or parts or numbers: The term does not include any document published in the course of his duty by the Government Printer, or any paper containing only matter wholly of a commercial nature; " Operator of a printing press "—Person responsible for operating a printing press; " Paper "—Includes pamphlet and newspaper; " Part "—Part of this Act; " Person "—Includes a company; " Place "—Includes a house, building, tent, vehicle, and vessel; " Place of residence "—Includes the street or other place where the person to whom it refers resides, and the number (if any) or other description of the house or other place in which he so resides; "Prescribed "—Prescribed by this Act; "Print "—Includes take a copy from types, stones, or plates of any description; "Printing Press "—Includes types for printing, every machine or contrivance for transferring an impression from types or stereoplates, and every machine or contrivance used in the process of printing, but does not include the machine called a typewriter; " Proclamation "- 16.4 Proclamation made under this Act; "Proprietor "—Used with reference to any newspaper includes as well the sole proprietor of the newspaper as also, in the case of a divided proprietorship, the persons who, as partners or otherwise, represent and are responsible for any share or interest in the

Printers and Newspapers Act. 269 P art I.— P reliminary . newspaper as between themselves and the persons in like manner representing 01 responsible for the other shares or interests therein, and no other person; “ Registrar ”—The Registrar of the Supreme Registrar Court of Queensland at Brisbane, Rockhampton, or Townsville, as the case may be : The term includes any Deputy Registrar of the Supreme Court and any officer of the Supreme Court authorised by the Minister to perform the duties of a Registrar for the purposes of this Act; “ Regulations ”—Regulations made under or Regulations, continued in force by this Act; “ Sell ”—Includes auction, barter, exchange, or Sell, supply, or cause, permit, or attempt, any of those things, and also offer or attempt to sell, and supply or receive for sale, or have in possession for sale, or expose for sale, or send, forward, or deliver for sale or on sale, or cause, or suffer, or allow to be sold or offered for sale, or dispose or offer for disposal under any.hire purchase agreement; “ This Act ”—This Act and all Proclamations This Act. and regulations continued in force or made hereunder; ' “ Use ”—Use for printing or any purpose use. associated with or incidental to printing; (2.) Derivatives of any term to which a meaning Derivatives, is assigned by this section shall, in this Act, unless the context otherwise indicates or requires, have a corresponding meaning. (3.) Any reference in this Act to any other Act Reference u> shall be taken to include a reference to any later Actother Aots‘ amending or in substitution for that other Act. P ast II. —A dministration . P art II.— am 5Stba' 6. (1.) The Governor in Council may from time to Officers, time appoint under and for the purposes of this Act a Chief Inspector and such and so many other inspectors and other officers as he deems necessary for the effectual execution of this Act.

No. 8, The Chief Inspector, other inspectors and other officers shall be appointed and hold their respective offices under, subject to, and in accordance with *“ The Public Service Acts, 1922 to 1950.” (2.) Without limiting the generality of the provisions of subsection one of this section— (i.) Any Registrar and any officer of any Department of the Government of this State may be appointed an inspector for the purposes of this Act and each and every such appointee may hold such appointment in conjunction with the office for the time being held by him in his Department; (ii.) Any appointment as inspector under that subsection may, if the Governor in Council deems necessary or desirable, be made by the appointment to be inspector of the holder for the time being of an office under the Crown in right of this State, specifying that office but without naming the holder; and in every such case each successive holder of the office in question and each person who for the time being occupies or performs the duties of that office shall, without further appointment or other authority and while he holds or occupies or performs the duties of that office, be an inspector in terms of such appointment, and may hold both his office and such appointment in conjunction. (3.) The Governor in Council may at any time cancel any appointment made in pursuance of this section. (4.) The Minister or the Chief Inspector may from time to time by writing or by telegram appoint any person who holds for the time being any office under the Crown in right of this State to act as an inspector and while so acting such officer shall have and may exercise all of the powers, functions, and authorities of an inspector. The Minister in every case and the Chief Inspector in the case of an appointment made by him may by writing or by telegram cancel an appointment made under this subsection. * 13 G. 5 No. 31 and amending Acts.
1953. PRINTING. Printers and Newspapers Act. 271 P ast II.— A dmintstea - TION. 7. (1.) An inspector may at any time— Powers, &c., of inspectors. (i.) Enter any place at which any printing press is or is suspected by him to be kept or in which any books or papers are or are suspected by him to be published ; (ii.) Inspect and examine any printing press, books, and papers found upon such entry ; (iii.) Make such examination and inquiry as may be necessary to ascertain whether this Act has been or is being complied with and interrogate any person for that purpose and require any such person to answer the questions put and to sign a declaration of the truth of his answers ; (iv.) Require any person whom he finds committing or whom he reasonably suspects has committed any offence against this Act, or whom he is authorised to question for the purposes of this Act, or whose name is in his opinion reasonably required for a purpose of this Act, to state his name and address and, if he has reasonable ground for suspecting that the name or address, or name and address as stated is false, require evidence of the correctness thereof; (v.) Require any person to produce for inspection any record, certificate, book, or paper required by this Act to be kepi) by that person ; (vi.) Take possession of any printing press found at any place not registered under Part III. as a place at which a printing press is kept where he is satisfied on reasonable grounds that the printing press has been abandoned and dispose of it in such manner as may be prescribed, or if the manner of such disposal is not prescribed, then in such manner as may be directed by the Minister ; (vii.) Call to his aid any member of the police force where he has reasonable cause to apprehend any obstruction in the exercise of his powers or in the execution of his duties; (viii.) Exercise such other powers and authorities as may be prescribed.

Every inspector shall where possible be furnished with a certificate of appointment, and any inspector upon entering any place shall, if required, produce that certificate (unless his appointment has been made by telegram when he shall, if required, produce that telegram) to the occupier thereof. 8. (1.) Any justice of the peace who, from information upon oath, has reason to suspect that any printing press or printing presses is or are used or kept in contravention of this Act at any place may issue his warrant directing all or any members of the police force to enter, by force if necessary, and to search such place and to seize and remove and detain every printing press, all books and papers, and anything which may afford evidence as to the commission of any offence against this Act there found. Such warrant shall be sufficient authority to do the things thereby directed and shall be executed according to the directions therein contained, and may be executed by any members of the police force at any time by day or night. (2.) Unless sooner— (a) An order for the delivery thereof is made in pursuance of section thirty-nine of *“ The Justices Acts, 1886 to 1949,” by a Court of Petty Sessions in a Petty Sessions District in or within twenty miles of the boundaries whereof the seizure shall have been made; or (b) It is established to the satisfaction of the Minister that at the time of the seizure thereof no offence against this Act had been committed in relation thereto, every printing press, all books and papers, and anything which may afford evidence as to the commission of any offence against this Act so seized may be detained for a period of twelve months, or, if within that period proceedings for an offence against this Act in relation thereto, or proceedings for any offence in which such printing presses, books and papers, or other things are or can properly be adduced in evidence, have been instituted, until the final determination of these proceedings, including any appeal in the matter of those proceedings. * 50 V. A person shall not at any time after the thirty- w^n first day of January next following the commencement of of^Sting0'’ this Act keep or use or assist in' or cause or procure the P^f^8., keeping or using of any printing press— prohib ’ ited. (i.) At any place which is not then registered under this Part as a place at which a printing press is kept; or (ii.) At any place then registered under this Part as a place at which a printing press is kept unless— (a) He is then registered (whether alone or jointly with another or others) under this Part as a printing press proprietor at that place ; or (b) He is then registered under this Part as an operator of a printing press kept at that place by a company then registered under this Part as a printing press proprietor at that place ; or (c) He is then under the direction and control of a person specified in subparagraph (a) or subparagraph (6) aforesaid. 10. (a) Every person— Application • . for (i.) Who at any time after the commencement of registration this Act and before the first day of February this next following such commencement keeps any ’ printing press at any place whatever; or (ii.) Who at any time after the thirty-first day of January next following the commencement of this Act intends to keep any printing press at any place which is not registered under this Part as a place at which a printing press is kept, shall— (iii.) In the case of subparagraph (i.) aforesaid, during the month ending on the thirty-first day of January next followjing the commencement of this Act: and

In the case of subparagraph (ii.) aforesaid, before he commences to there keep the printing press, make application under .and in accordance with this Part for the registration under this Part of— (a) The place at which the printing press is or, as the case may be, is intended to be kept as a place at which a printing press is kept; (b) Himself or, in the case of a joint application, of themselves as a printing press proprietor at that place ; and (c) Where that person is a company, the persons who are or will be operators of the printing press kept at that place by the company. (b) In this Part such an application is referred to as an “ application for registration ”. Mode of 11. (1.) Applications for registration or for renewal faoprplication of registration under this Part shall be made in accordance registration with this section. or for renewal of (2.) An application for registration or for renewal registration. of registration shall be lodged— (i.) Where the place, application for registration or renewal of registration of which as a place at which a printing press is or is intended to be kept, is situated in the Central District as defined in the First Schedule to *“ The Central and Northern Districts Boundaries Act of 1900,” with the Registrar of the Supreme Court at Rockhampton ; (ii.) Where the place, application for registration or renewal of registration of which as a place at which a printing press is kept, is situated in the Northern District as defined in the Second Schedule to *“ The Central and Northern Districts Boundaries Act of 1900,” with the Registrar of the Supreme Court at Townsville ; (iii.) In any other case, with the Registrar of the Supreme Court at Brisbane. (3.) Every such application, if made by a person other than a company, shall be an affidavit in or to the effect of Form A in the Schedule to this Act or, if made * 64 V. No. 2.

Printers and Newspapers Act . 275 P art ni.— P rinting P resses . by a company, shall be an affidavit in or to the effect of Form B in the Schedule to this Act, and in each case shall contain the particulars required thereby to be supplied therein, and shall comply with the provisions of section seventeen of this Act. 12. (1.) Upon the lodging with him of an application Re8istration- for registration or for renewal of registration and upon being satisfied that the application has been made in accordance with this Part, the Registrar shall, according as set out in such application, record in a register which shall be kept by him in his registry for the purposes of this Part under the name “ Register of Printing Press Proprietors ” (hereinafter in this Part referred to as the “ register ”) the following particulars :— (i.) The description of the place which is registered as a place at which a> printing press is kept; (ii.) The name and place of residence or, in the case of a company the name and address in this State of its registered office, of the person who is or, in the case of a joint registration, of each of the person? who are registered as a printing press proprietor at that place firstmentioned ; and (iii.) Where that person is a company, tjhe names and places of residence respectively of the persons who are registered as operators of the printing press kept at that place firstmentioned by the company ; and shall enter in that register the date and time of the recording of those particulars and shall forthwith issue to the applicant a certificate in or to the effect of Form C in the Schedule to this Act. (2.) Subject to this Act, the registration or renewal Period of of registration of the place or any of the persons specified registratlon' in subparagraphs (i.), (ii.), and (iii.) of subsection one of this section shall commence on the date and at the time when particulars thereof are recorded in the register and shall continue in force until— (i.) Where that registration or renewal of registration is effected during the month of January of any year, the last moment of the thirty-first day of January of the next succeeding year; and

Where that registration is effected during any other month, the last moment of the thirty-first day of January next following, and shall then expire unless during the month on the last day of which that registration expires, the registration is renewed in accordance with the provisions of this Part. Any registration which expires or is cancelled under this Part shall no longer have effect. Application 13. (a) Every person who is registered under this froernewal of Part as a printing press proprietor at a place registered registration under this Part as a place at which a printing press is mmaadyeb. e kept may, during the month of January of any year, make application under and in accordance with this Part for the renewal of registration under this Part of— (i.) That place as a place at which a printing press is kept; (ii.) Himself, or in the case of a joint application, of themselves as a printing press proprietor at that place ; and (iii.) Where that person is a company, the persons who are registered under this Part as operators of the printing press kept at that place by the company, as such operators. (b) In this Part such an application is referred to as an “ application for renewal of registration ”. When removal of printing press prohibited. 14. Except with the prior permission in writing of the Chief Inspector, a person shall not remove or cause or allow to be removed any printing press from a place then registered under this Part as a place at which a printing press is kept to any place not so registered. The Chief Inspector at his discretion may from time to time permit by "writing under his hand the removal of any printing press subject to such provisions, conditions, and stipulations as he may deem fit to specify therein, and the removal to and keeping, and if permitted, using, at the place to which the removal is authorised of the printing press in compliance in every respect "with that permission shall not be an offence against this Act. Any person who fails to comply in any respect -with any permission granted under this section shall be guilty of an offence against this Act and liable to the prescribed

Printers and Newspapers Act. 277 P art III.— P rinting P resses . penalty for such failure, as well as being liable, aS if that permission had not been granted, to any other penalty for offending against any provision of any other section of this Act 15. (1.) Every person who is registered under this Notifica- Part as a printing press proprietor at a place registeredtlons’&0, under this Part as a place at which a printing press is kept, upon any change in the particulars relating to his registration occurring, shall immediately give notification thereof, as prescribed by subsection four of this section, to the Registrar keeping the register wherein that registration is recorded. (2.) For the purposes of subsection one of this section, a change shall be deemed to occur in the particulars relating to the registration of a person in that subsection referred to— (i.) As soon as no printing press is kept at the place at which he is a printing press proprietor as registered; or (ii.) (Where he is jointly registered as a printing press proprietor at the place with another or others) when any person so jointly registered ceases to keep the printing press at that place ; or (iii.) When any change occurs in the name or place of residence or, in the case of a company, in its name or address in this State of its registered office, of that person, or in the case of a joint registration as a printing press proprietor at the place, of any person so jointly registered; or (iv.) (Where the person is a company) when any change occurs in the name or place of] residence of any person who is registered under this Part as an operator of the printing press kept at the place by the company, or any person as lastmentioned ceases to be an operator of such printing press. (3.) (a) Where any person who is not registered under this Part as a printing press proprietor at a place registered under this Part as a place at which a printing press is kept, intends to keep a printing press at that

No. 8, place then, before he commences to there keep the printing press, he and every person who is so registered as a printing press proprietor at that place shall jointly make application under and in accordance with this section to the Registrar keeping the register wherein those registrations are recorded, for the registration under this Part of the firstmentioned person as a printing press proprietor at that place. ( b ) Any company registered under this Part as a printing press proprietor at a place registered under this Part as a place at which a printing press is kept, may at any time make application under and in accordance with this section to the Registrar keeping the register wherein those registrations are recorded, for the registration under this Part of any persons as operators of the printing press kept at that place by the company. (4.) Every notification and every application under this section shall be an affidavit in or to the effect of Form D in the Schedule to this Act, shall contain the particulars required thereby to be supplied in relation to that notification or, as the case may be, application, and shall comply with the provisions of section seventeen of this Act. (5.) (a) Upon the lodging with him of a notification or, as the case may be, an application under this section and upon being satisfied that the same has been given or, as the case may be, made under and in accordance with this section, the Registrar shall in his register, according as set out in the notification or application,— (i.) In the case referred to in subparagraph (i.) of subsection two of this section, cancel the registration as a place at which a printing press is kept of the place where no printing press is now kept and, in addition, cancel all other registrations with respect to that place; or (ii.) In a case referred to in subparagraph (ii.) of subsection two of this section, cancel the registration as a printing press proprietor at the place of the person who has ceased to keep the printing press at that place ; or

In a case referred to in subparagraph (iii.) of subsection two of this section, record the change in name, place of residence, or address of the registered office of the person registered as a printing press proprietor at the place and with respect to whom such change is notified : or (iv.) In a case referred to in subparagraph (iv.) of subsection two of this section, record the change in name or place of residence of the person registered as an operator of the printing press kept at the place by the company and with respect to whom such change is notified, or, as the case requires, cancel the registration as such operator of the person who has ceased to be an operator of such printing press ; or (v.) In a case referred to in paragraph ( a) of subsection three of this section, record particulars of the name and place of residence or, in the case of a company, of its name and address m this State of its registered office of the person who is newly registered as a printing press proprietor ar th e place ; or (vi.) In a case referred to in paragraph ( b ) of subsection three of this section, record particulars of the names and places of residence respectively of the persons who are registered as operators of the printing press kept at the place by the company, and shall enter in that register the date and time of such cancellation, or, as the case may be, recording and shall forthwith issue to the person giving the notification or, as the case may be, applicant a certificate in or to the effect of Form E in the Schedule to this Act. ( b) The registration in a register under this subsection of any persons referred to in subparagraphs (v.) and (vi.) of paragraph (a) of this subsection shall commence on the date and at the time when particulars thereof are recorded in the register and the provisions of subsection two of section twelve of this Act shall apply in respect thereof as if that registration were a registration in that subsection referred to.

The Registrar— (i.) May refuse to take any action upon any application or notification lodged or purporting to be lodged under this Part with him, if he is not satisfied that that application or, as the case may be, notification, has been given or made in accordance with this Part; fii.) Upon being satisfied at any time by such evidence or information as he thinks fit that any notification being required by subsection one of section fifteen of this Act to be given to him has not been given, may, in his discretion, cancel any registration or record any change in name, place of residence, or place of business in his register as if that notification had, in fact, been given. (2.) Any person aggrieved by any refusal, cancellation or record of change specified in subsection one of this section may by application made by originating summons obtain the opinion thereon of a Judge of the Supreme Court and the Registrar shall act upon that opinion accordingly. (3.) Any cancellation or recording pursuant to this section of any registration or of any change in the particulars relating to any registration under this Part shall not prejudice or otherwise affect any proceedings or any steps or any other action whatsoever which is or are or may be taken with respect to a failure to .give any notification as required by this Part to be given or with respect to any other offence against this Act. Signing of applications, 17. Every application or notification made or, as cage may giyen under this Part shall be sworn and signed by the applicant or applicants or person or persons giving the notification, as the case may be, and in the case of a company, shall be sworn and signed on the company’s behalf by its secretary or its manager, managing director, or other governing officer by whatsoever name called. No such application or notification shall be made or, as the case may be, given under any firm name within the meaning of *“ The Registration of Firms Act of 1942.” * 6 G. 6 No. 24.
PRINTING. 281 1953. Printers and Newspapers Act. P art IV.—I mprinting . P art IV.— I mprinting . 18. (l.) This Part shall not apply to— Exemptions from Part. (i.) Any book or paper printed by order or under the authority of the Legislative Assembly or of any Department of the Government of this State ; (ii.) Any representation of a work of art; (iii.) Any paper containing only the name, address, telephone number, business, or profession of any person, and the articles in which he deals, or some one or more of these particulars; (iv.) Any papers containing only information relating to proposed sales of property; (v.) Bank notes, bills of exchange, dividend warrants, promissory notes, or other securities for payment of money; (vi.) Bills of lading ; (vii.) Policies of insurance ; (viii.) Deeds, powers of attorney, agreements, instruments relating to real property, and other forms for use in preparing legal documents; (ix.) Stocks, shares, bonds, debentures, or other like securities and transfers and assignments thereof; . (x.) Receipts for money or goods ; (xi.) Documents used in proceedings in courts such as writs, summonses, complaints, plaints, and warrants ; (xii.) Any circular or letter from any company or from any association registered under any Act to the directors, shareholders or members thereof, which bears the true name and address or place of business of the secretary or other officer thereof, or any circular notice or letter issued by any person and bearing his true name and address; (xiii.) Any other books or papers exempted from this Part by Proclamation.

Every person who prints any book or opnrinbtoonkasme paper for publication or distribution shall print in and papers. legible characters his name and address on every such book or paper, in accordance with the requirements of this section, and where that paper is a newspaper, shall, in addition, print in legible characters the name and address of the publisher thereof and the address of the place where the newspaper is printed in accordance with the requirements of this section. (2.) The name and address or, in the case of a newspaper as aforesaid, each name and each address shall be printed both before the commencement of, and after the end of, the other printed matter in the book or paper: Provided that on a paper consisting of one sheet only, the name and address or, as the case requires, each name and each address may be printed at the bottom of the front page thereof. (3.) {a) The address of the printer or publisher to be printed on a book or paper pursuant to this section shall be— (i.) Where the printer or, as the case may be, publisher is a company the address of its registered office ; (ii.) Where the printer or, as the case may be, publisher is an individual person the address of his usual place of residence or, where there is more than one person, of each person’s usual place of residence respectively. ( b ) The term “ address ” for the purposes of this section includes the number (if any) or other description of the house or building and the street in which the house or building is situated. (4.) If the printer or, as the case may be, publisher is then a firm within the meaning of *“ The Registration of Firms Act of 1942,” and registered under that Act the firm name and its sole or, as the case may be, principal place of business in this State as so registered may be printed thereon instead of the names of the individual members and the address of each member’s place of residence. (1.) (2.) This section shall apply with respect to books and papers whether printed before, on, or after the coming into operation of this Act. Print any newspaper unless he is then registered under this Part as the printer ol that newspaper or is then under the direction and control of a person so registered ; (iii.) Print any newspaper at any place other than the place then registered under this Part as where that newspaper is or will be printed ; (iv.) Publish any newspaper unless he is then registered under this Part as the publisher of that newspaper or is then under the direction and control of a person so registered ;

Be or hold himself out to be a proprietor of any newspaper printed or published in this State unless he is then registered under this Part as a proprietor of that newspaper ; (vi.) Wilfully sell or deliver any newspaper when the persons who are then the proprietor or proprietors, printer or printers, and publisher or publishers respectively of that newspaper, and the place where that newspaper is then printed, as required by this Part to be registered hereunder, are not then so registered. Application 23. (a) With respect to every newspaper printed ftoiornr.egistra or published or intended to be printed or published in this State, the publisher or, in the lastmentioned cases, the person intended to be the publisher thereof shall— (i.) In the case of a newspaper printed at any time after the commencement of this Act and before the first day of February next following such commencement, during the month of January next following the commencement of this Act; and (ii.) In the case of a newspaper intended to be printed at any time after the thirty-first day of January next following the commencement of this Act, before such printing, lodge under and in accordance with this Part the prescribed application sworn and signed by the persons prescribed for the registration under this Part of— (a) The person or persons who are or will be the proprietors of that newspaper as such proprietor or proprietors; ( b) The person or persons who are or will be the printers of that newspaper as such printer or printers; (c) The person or persons who are or will be the publishers of that newspaper as such publisher or publishers ; (d) The place where that newspaper is or will be printed as such place. (6) In this Part such an application is referred to as an “ application for registration”.

Applications for the registration or renewal Mod? °f of registration under this Part shall be made in accordance “w>licatl0n with this section. registration and for (2.) An application for registration or for renewal renewal of registration of a newspaper shall he lodged— r ™ egistration. (i.) Where the place at which the newspaper is or will be printed is situated in the Central District as defined in the First Schedule to *“ The Central and Northern Districts Boundaries Act of 1900,” with the Registrar of the Supreme Court at Rockhampton; (ii.) Where the place at which the newspaper is or will be printed is situated in the Northern District as defined in the Second Schedule to *“ The Central and Northern Districts Boundaries Act of 1900,” with the Registrar of the Supreme Court at Townsville ; (iii.) In any other case, to the Registrar of the Supreme Court at Brisbane. (3.) Every such application, where the proprietor of the newspaper is a person other than a company, shall be an affidavit in or to the effect of Form F in the Schedule to this Act or, where the proprietor of the newspaper is a company, shall be an affidavit in or to the effect of Form G in the Schedule to this Act, and in each case shall contain the particulars required thereby to be supplied therein, shall be duly sworn and signed by the prescribed persons and shall comply otherwise with the provisions of section twenty-eight of this Act. 25. (1 •) Upon the lodging with him of an application Registration, for registration or for renewal of registration and upon being satisfied that the application has been made in accordance with this Part, the Registrar shall, Recording as set out in such application, record in a register which shall be kept by him in his registry for the purposes of this Part under the name “ Register of Newspapers ” (hereinafter in this Part of this Act referred to as the “ register ”) the following particulars :— (i.) The name and place of residence (or in the case of a company the name and address in this State of its registered office, or in the case of a firm within the meaning of *“ The Registration of Firms Act of 1942,” and registered under that Act the firm name and its sole or principal place of business as so registered), of the person or persons who are registered as the printers of the newspaper; (iii.) The name and place of residence (or in the case of a company the name and address in this State of its registered office, or in the case of a firm within the meaning of *“ The Registration of Firms Act of 1942,” and registered under that Act the firm name and its sole or principal place of business as so registered), of the person or persons who are registered as the publishers of the newspaper ; and (iv.) The description of the place which is registered as the place where the newspaper is or will be printed; and shall enter in that register the date and time of the recording of those particulars and shall forthwith issue to the person lodging the application a certificate in or to the effect of Form H in the Schedule to this Act. Where that registration is effected during any other month, the last moment of the thirty-first day of January next following, and shall then expire unless during the month on the last day of which that registration expires, the registration is renewed in accordance with the provisions of this Part. Any registration which expires or is cancelled under this Part shall no longer have effect. (3.) (a) The person or persons who are registered Application under this Part as the publishers of any newspaper may, 0fr renewa during the month of January of any year, lodge under registration, and in accordance with this Part the prescribed application, sworn and signed by the persons prescribed for the renewal of registration under this Part if the persons so registered as the proprietor or proprietors, printer or printers, and publisher or publishers respectively of the newspaper and the place so registered as where that newspaper is printed. ( b) In this Part such an application is referred to as an “ application for renewal of registration ”. 26. (1.) The person or persons who are registered Notifica- under this Part as the publisher or publishers of atl0ns’&c newspaper, upon any change in the particulars relating to any registration under this Part with respejct to that newspaper occurring, shall immediately give notification thereof, as prescribed by subsection four of this section, to the Registrar keeping the register wherein that registration is recorded. (2.) For the purposes of subsection one of this section, a change shall be deemed to occur in the particulars relating to a registration under this Part with respect to a newspaper— (i.) As soon as the newspaper ceases to be printed at the place registered under this Part as where that newspaper is or will be printed or as soon as the newspaper ceases to be published ; or (ii.) Upon any transfer or transmissibn; of or dealing with any share or interest in the newspaper whereby any person ceases to be a proprietor ; or

Upon any person registered under this Part as a printer or publisher of the newspaper ceasing to he a printer or, as the case may be, publisher thereof; or (iv.) When any change occurs in the name or place of residence of a person registered as a proprietor, printer, or publisher of the newspaper, or in the case where such printer or publisher is a company in its name or the address of its registered office, or where such printer or publisher is a firm within the meaning of *“ The Registration of Firms Act of 1942,” and registered under that Act, in the firm name or in its sole or principal place of business as so registered. (3.) The person or persons who are registered under this Part as the publisher or publishers of a newspaper may at any time lodge with the Registrar keeping the register wherein the registrations with respect to that newspaper are recorded an application under and in accordance with this section for the registration under this Part as proprietor, printer or publisher of the newspaper of any person not so registered or of a place (other than the place registered under this Part as where the newspaper is printed) as the place where the newspaper will in future be printed. (4.) Every notification and every application under this section shall be an affidavit in or to the effect of Form I in the Schedule to this Act, shall contain the particulars required thereby to be supplied in relation to that notification or, as the case may be, application, and shall be duly sworn and signed by the prescribed persons and shall comply otherwise with the provisions of section twenty-eight of this Act. (5.) (a) Upon lodging with him of a notification or, as the case may be, an application under this section and upon being satisfied that the same has been given or, as the case may be, lodged and otherwise made under and in accordance with this section, the Registrar shall in his register, according as set out in the notification or application,— (i.) Where the newspaper has ceased to be published, cancel all registrations under this Part with respect to the newspaper ; or * 6 G. 6 No. 24. !

Where the newspaper has ceased to be printed at the place registered under this Part as where the newspaper is printed and an application is made for the registration of some other place as the place at which the newspaper will in future be printed, cancel the registration of such firstmentioned place and record the description of the lastmentioned place which is newly registered as the place where the newspaper will he printed; or (iii.) Cancel the registration of the person ceasing to be proprietor, printer, or publisher of the newspaper, as a proprietor, printer or, as the case may be, publisher thereof, or where an application is made for registration of a new proprietor, printer, or publisher, record particulars in relation to that person as if that application were an application for registration; or (iv.) In the case of a notification of change in name, place of residence, address of registered office, or place of business as registered, record particulars of such change, and shall enter in that register the date and time of such cancellation or, as the case may be, recording and shall forthwith issue to the person giving the notification or, as the case may be, lodging the application, a certificate in or to the effect of Form J in the Schedule to this Act. If, upon any application lodged under this section for the registration with respect to any newspaper of a place (other than the place registered under this Part as where the newspaper is or will be printed) as the place where the newspaper will in future be printed, the Registrar with whom that application is duly lodged is of the opinion that all registrations with respect to that newspaper may more conveniently be dealt with by some other Registrar, then he may, after taking the steps upon that application as hereinbefore required by this section and endorsing the Form J certificate issued by him with a notification of the transfer of the K

No. 8. registrations, cause all the registrations with respect to that newspaper to be transferred to and recorded in the register kept by that other Registrar. (b) The registration with respect to any newspaper in a register under this subsection of any persons or any place shall commence on the date and at the time when particulars thereof are recorded in the register and the provisions of subsection two of section twenty-five of this Act shall apply in respect thereof as if that registration were a registration in that section referred to. Powers, &c., of Registrar. 27. (1.) The Registrar— (i.) May refuse to take any action upon any application or notification lodged or purporting to be lodged under this Part with him, if he is not satisfied that that application or, as the ease may be, notification, has been given or made in accordance with this Part; (ii.) Upon being satisfied at any time by such evidence or information as he thinks fit that any notification required by subsection one of section twenty-six of this Act to be given to him has not been given, may, in his discretion, cancel any registration or record any change in name, place of residence, address of registered office, or place of business in his register as if that notification had, in fact, been given. (2.) Any person aggrieved by any refusal, cancellation or record of change specified in subsection one of this section may by application made by originating summons obtain the opinion thereon of a Judge of the Supreme Court and the Registrar shall act upon that opinion accordingly. (3.) Any cancellation or recording pursuant to this section of any registration or of any change in the particulars relating to any registration under this Part shall not prejudice or otherwise affect any proceedings or any steps or any other action whatsoever which is or are or may be taken with respect to a failure to give any notification as required by this Part to be given or with respect to any other offence against this Act.

Every application or notification I made or, individual as the case may be, given under this Part with respect pX^hers^ to any newspaper shall be sworn and signed by—- (i.) In the case of an application for registration, by the persons who are or, as the case may be, intend to be the proprietor or proprietors, printer or printers, and publisher or publishers respectively of the newspaper ; (ii.) In the case of an application for renewal of registration, by the persons who are then registered under this Part as the proprietor or proprietors, printer or printers, and publisher or publishers respectively of the newspaper ; (iii.) In the case of a notification or application under section twenty-six of this Act, by the persons who are then registered under this Part as the proprietor or proprietory, printer or printers, and publisher or publishers respectively of the newspaper, and, where an application is made for the registration of a new proprietor, printer, or publisher by that new person : Provided that for the purposes hereof, in the case of a company or of any firm within the meaning of *“ The Registration of Firms Act of 1942,” and registered under that Act, any such application shall be deemed to be sworn and signed, by that company if sworn and signed on the company’s behalf by its secretary or its manager, managing director, or other governing officer by whatsoever name called, or by that firm if sworn and signed on the firm’s behalf by any member of the firm then registered as such under *“ The Registration of Firms Act of 1942.” (2.) Every application for the registration under this Part of any company, or of any firm within the meaning of *“ The Registration of Firms Act of 1942,” and registered under that Act, as a printer or publisher of any newspaper shall, in addition, contain an application for the registration of some individual person or persons (who shall be in charge or otherwise closely connected with the printing or, as the case may be, publishing of the newspaper) as a printer or, as the case may be, publisher of the newspaper. * 6 G. 6 No. 24.

Every person who prints any book or pkreienptecroptoies. paper for publication or distribution shall— (i.) Keep at least one copy of such book or paper for at least six months after the last copy thereof was printed ; (ii.) Write or print on a copy so kept the name and usual place of residence of the person on whose behalf he printed such book or paper ; and (iii.) On demand made by any person prescribed by the regulations or made by any inspector within that period produce the copy specified in subparagraph (ii.) of this section to that person or inspector and allow him to inspect the same. (2.) (1.) A person shall not— (i.) Make or attempt to make or cause or permit to be made any application, or give or attempt to give or cause or permit to be given any notification, under and for the purposes of this Act which contains any particulars which are false or misrepresented or from which any particulars have been omitted whereby such application or, as the case may be, notification may mislead ; (ii.) Forge or counterfeit any certificate issued under this Act or knowingly utter or make use of any such certificate so forged or counterfeited; (iii.) Knowingly utter or make use of as applying to any person or to any printing press or newspaper any such certificate which does not so apply ;

Falsely pretend to be an inspector ; (vi.) Connive at any such forging, counterfeiting, uttering, making use, personating, or pretending as aforesaid; (vii.) Make or sign a false affidavit under or for any purpose of this Act; or (viii.) Knowingly make use of any such false entry or affidavit as aforesaid. (2.) Any person guilty of an offence against this section shall be liable to a penalty of not more than one hundred pounds or to imprisonment, with or without hard labour, for any period not exceeding six months or to both such penalty and imprisonment. 32. A person shall not--- Obstructing (i.) Assault, obstruct, threaten, abuse, insult, or !&®pectors’ intimidate any inspector in the exercise of his powers or in the discharge of his duties under this Act, or attempt, or invite, or encourage any other person so to do ; or (ii.) Fail to answer any question put to him in pursuance of this Act by any inspector or give any false or misleading answer to any such question; or (iii.) Fail to comply with the lawful requisition or any part of the lawful requisition of any inspector; or (iv.) When required under this Act to furnish any information or evidence to any inspector, fail to furnish that information or evidence, as the case may be, or furnish false or misleading information or evidence; or (v.) Directly or indirectly prevent any person from appearing before or being questioned by an inspector, or attempt so to do: Provided that no person shall be required under this section or under any other provision of this Act to answer any question, or to give any inforrttation or evidence, or to sign any declaration tending to criminate himself.

(ct) Any person who contravenes or fails to comply with any provision of this Act shall be guilty of an offence against this Act. (b) Every person who aids, abets, counsels, or procures, or is in any way knowingly concerned in the commission of an offence against this Act shall be deemed to have committed that offence and shall be punishable accordingly. General penalty. (2.) Any person guilty of an offence against any provision of this Act shall be liable, if no specific penalty is provided for that offence, to a penalty not exceeding one hundred pounds. Summary (3.) All offences against this Act may be prosecuted proceedings. in a summary way under *“ The Justices Acts, 1886 to 1949,” on complaint by any person authorised by the Minister and any offence against this Act where the offender is arrested under this Act may be so prosecuted on complaint of the person who made the arrest, without such authority. Time for (4.) A prosecution for an offence against this Act mcoemnmt oenf ce may be instituted at any time within twelve months prosecutions. after the commission of the offence or within twelve months after the commission of the offence comes to the knowledge of the complainant, whichever is the later period. Company. (5.) When a company commits an offence against this Act the manager, managing director, or other governing officer, by whatever name called, of such company shall also be deemed to commit such offence, and proceedings may be taken either against the company or against that manager, managing director, or other governing officer, and if proceedings are taken against the manager, managing director, or other governing officer, he shall upon conviction for that offence, be liable to the penalty prescribed for the offence. Arrest. 34. Where an offence against this Act is committed in the presence of any member of the police force then that member of the police force may arrest the offender and take him before justices to be dealt with according to law. * 50 V. Unless otherwise expressly provided all printing Forfeiture presses, books, papers, and other things whatsoever seized under this Act and in relation to which any offence against this Act has been committed shall, if the court convicting any person for that pffence in its discretion so orders, be and be deemed to be forfeited to Her Majesty in right of this State and such forfeiture shall, if the court at its discretion so further orders, extend to the whole of any other printing presses, books, papers, and other things, if any, seized with the printing presses, books, papers, or other things first mentioned: Provided that the Minister may, in his absolute discretion, upon being satisfied that any such printing presses, books, papers, or other things are the property of a person (other than the person or persons convicted) who has used all due diligence to enforce the execution of this Act and that the offence has been committed without his knowledge, consent, or connivance, order that such appliance or other thing be delivered to that person on such conditions, if any, as the Minister thinks fit. Any person who contravenes or fails to comply with any such condition shall be guilty of an offence against this Act.36 36. (1.) In any proceeding under or for a purpose of Facilitation this Act or in any proceeding (civil or criminal andof Proof< whether under this Act or not) touching any newspaper or anything therein contained— (i.) It shall not be necessary to prove the appointment of the Chief Inspector or of any other inspector; (ii.) A signature purporting to be that of a Registrar or of the Chief Inspector or of any other inspector shall be taken to be the signature it purports to be until the contrary is proved ; (iii.) A document which purports to be a copy of or extract from any application, notification, or other document made or given to or lodged with any Registrar under or for the purposes of this Act or of any particulars recorded pursuant to this Act in any register kept under this Act and endorsed with a certificate purporting to be finder the hand of the Registrar having custoay of the original document or, as the case may be, register that such firstmentioned document

No. 8, is a true and correct copy of or, as the case may be, extract from that original or register shall, upon its production in evidence, be evidence of the matters contained and certified to therein and, in the absence of evidence in rebuttal, shall be conclusive evidence of such matters ; (iv.) Any affidavit (including any application or any notification) made or given to or lodged with any Registrar under or for the purposes of this Act shall be conclusive evidence as against every person signing the same of the truth of all particulars therein set forth ; (v.) Service of any process, document, or writing at the place registered under this Act as where the newspaper is or will be printed shall be taken to be sufficient service thereof against the persons respectively registered under this Act as the proprietor, printer, or publisher of such newspaper ; (vi.) Against any person who has made any affidavit under or for the purposes of this Act, if it or a certified copy thereof (which copy the Registrar shall be bound to furnish on payment of the prescribed fee) is produced in evidence, and if a newspaper is so produced intituled in the same manner as the newspaper mentioned in such affidavit or copy, and in which the names of the printers and publishers and the place of printing are the same as the names of the printers and publishers and the place of printing mentioned in such affidavit or copy, it shall not be necessary to prove that the newspaper to which the proceedings relate was purchased at any house, shop, office, or other place belonging to or occupied by the defendant or his servants or where he or they severally carry on the business of printing and publishing or where the same is sold. (2.) Notwithstanding anything to the contrary contained in this Act, when any person who has made or who is referred to in an affidavit under or for the purposes of this Act touching any newspaper lodges with the Registrar with whom that affidavit was lodged

Printers and Newspapers Act . 297 P art VI.— M iscel laneous . a notification in the form of a further affidavit stating that he is no longer connected with the r ewspaper in the capacity set forth in such firstmentioned affidavit (authority to lodge such a notification being hereby given) he shall not, from the date on which he has lodged the same, be taken by reason of such firstmentioned affidavit or of any registration under this Act thereon only to be connected with such newspaper. 37. (1.) Subject to such provisions as may be searching prescribed by the regulations for the purpose hereof, registers, any person on payment of the prescribed fee and any person on behalf of any Department of the Government of this State without payment of such fee may at all reasonable times search any register kept for the purposes of this Act for any entries he desires to find and inspect the same and take copies thereof or make extracts therefrom. (2.) The Registrar of the Supreme Court at Townsville, copies of and the Registrar of the Supreme Court at Rockhampton, transmitted*6 shall at the end of every calendar month transmit to the in certain Registrar of the Supreme Court at Brisbane a copy°ases- certified under his hand of all entries made in his Register of Printing Press Proprietors and in his Register of Newspapers under this Act during that month. Every copy of an entry transmitted under this subsection shall be filed, kept, and indexed by the Registrar at Brisbane, and any person on payment of the prescribed fee may search, inspect, make extracts from and take copies of the same. (3.) The power to prescribe fees for the purposes of Prescribing this section shall include power to prescribe fees forof fees- searching which may differ from the fees prescribed for issuing certified copies of entries in registers or according as is prescribed. j (4.) The provisions of *“ The Oaths Acts,\ 1867 to Application 1924,” with any necessary adaptations, shall apply and oatteActs extend wherever possible to each and every application 1867 to ’ and notification made or given, as the case may be, 1924 ” under or for the purposes of this Act. 38. Where any person in any action in respect of Discovery defamatory matter alleged to be contained in any J^famation newspaper seeks the discovery of the name of any person in concerned in the property of or in such newspaper as newsPaPers- * 31 V. No. 12 and amending Acts.

No. 8, proprietor, printer, or publisher, or otherwise of any matter relating to the printing or publishing thereof, in order to enable him the more effectually to carry on such action, the defendant shall be compellable to make the discovery required. Power to exempt. 39. The Governor in Council may from time to time by Proclamation— (i.) Exempt from any of the provisions of this Act any books, papers, or any classes of books and papers specified in the Proclamation; (ii.) Declare that any of the provisions of this Act shall not apply to any printing press of a specified class or in the cases or circumstances specified with respect to any printing press; (iii.) Revoke or vary any Proclamation made under this section. Effect shall be given to every such Proclamation while that Proclamation remains in force accordingly.40 * Regulations. 40. (1.) The Governor in Council may from time to time make regulations providing for all or any purposes, whether general or to meet particular cases, that may be convenient for the administration of this Act or that may be necessary or desirable to carry out the objects and purposes of this Act. Without limiting the generality of the foregoing provisions of this section, regulations may be made for or in respect of all or any of the following purposes, matters, and things :— (i.) Prescribing, regulating and controlling the powers and duties of inspectors ; (ii.) Prescribing conditions for all or any registrations under this Act; (iii.) Prescribing fees payable under this Act and the matters in respect of which such fees shall be paid and prescribing the persons by whom and the places and times when and where such fees shall be paid ; (iv.) Prescribing the amount of any penalty for any offence against any regulation provided that any such penalty shall not exoeed fifty pounds;

The power to make regulations under this Act shall include power to repeal, amend, or otherwise modify any regulation in force at the commencement of this Act and continued in force by virtue of any provision of this Act. (2.) Regulations may be made at any time after the passing of this Act. 41. (1.) Every Proclamation and regulation made Publication under this Act shall— of Proclama tions and (i.) Be published in the Gazette ; regulations. (ii.) Upon its publication in the Gazette, be judicially noticed and such publication shall be conclusive evidence of the matters contained therein; (iii.) Take effect from the date of such publication unless, in the case of any such regulation, a later date is specified in that or hny other regulation for its commencement when in such event it shall take effect from that later date; and (iv.) Be laid before Parliament within fourteen sitting days after such publi<:ation if Parliament is in session, and if irot, then within fourteen sitting days after the commencement of the next session. (2.) If Parliament passes a resolution of which notice has been given at any time within fourteen sitting days after any such Proclamation or regulation has been laid before Parliament disallowing such Proclamation or regulation or part thereof, that Proclamation or regulation or part shall thereupon cease to have effect, but without prejudice to the validity of anything done in the meantime or to the making of a further Proclamation or regulation. (3.) In this section the term “ sitting days ” means days upon which Parliament actually sits for the despatch of business.42 42.
