An Act to authorize the Erection and Mainten­ ance of certain Buildings in Prince Alfred Park by the Municipal Council of the City of Sydney. [13th November, 1869.]

WHEREAS the portion of land known as " Prince Alfred Park"

containing by admeasurement eighteen acres and two roods

and situate at the intersection of Cleveland and Upper Castlereagh

Streets in the City of Sydney was by notice in the Government Gazette

dated the twenty-second day of December in the year one thousand eight hundred and sixty-five dedicated as a reserve for public recreation And whereas by notification in the said Gazette dated the twelfth day

of October in the year one thousand eight hundred and sixty-nine the
Municipal Council of Sydney were appointed Trustees of the said land And whereas the erection on the said land of suitable buildings for the purpose of holding annual and other Exhibitions and for like purposes of public recreation or instruction would be highly beneficial to the inhabitants of Sydney and to all persons concerned in promoting the agricultural pastoral and other interests of the Colony Be if therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—

1. I t shall be lawful for the Municipal Council of the City of Sydney Trustees of the portion of land at the intersection of Cleveland and Upper Castlereagh Streets known as Prince Alfred Park to erect and maintain upon such land such suitable buildings for the purposes hereinbefore mentioned as such Council may deem desirable.

2. It shall he lawful for the said Municipal Council to enclose such portion of the said Park as they may think fit and to let the land

so enclosed together with such buildings thereon erected for any

continuous period during the year not exceeding two calendar months and any public right of way or other easement attaching to such land
so enclosed shall during such period only as aforesaid in each year
cease and determine.

3. To provide funds for the erection of such buildings as afore­ said it shall be lawful for the said Municipal Council to borrow at a rate not exceeding six pounds per centum per annum any sum of money not exceeding twelve thousand pounds upon the security of their corporate revenues from whatever source arising Provided that the proceeds of the rent of such buildings and enclosures as aforesaid received by the said Council shall after payment of the current expenses incident to the maintenance of such buildings and enclosures be appro­ priated towards the payment off of the principal sum so borrowed and any interest thereon accrued And an account of such fund to be called the "Prince Alfred Park Fund" shall be kept by the City Treasurer.

4. The said Municipal Council may in addition to the powers conferred upon them as Trustees of the said Park by the Act of Council eighteenth Victoria number thirty-three make such by-laws for the maintenance and regulation of the said buildings and enclosures as they may deem desirable for the purpose of carrying out the provisions of this Act Provided that no such by-laws shall be of any force until the same shall have been approved of by the Governor and Executive Council nor until a copy thereof shall have been exhibited in some conspicuous place in the said Park and published in the Government

Gazette for at least one week And production of the Government Gazette containing such by-laws shall be ample evidence in all Courts of their validity.

5. This Act shall come into operation immediately upon passing

and shall be styled and may be cited as the "Prince Alfred Park
Enclosure Act."
