An Act to Amend "The Primary Products Pools THE Act of 1922" in certain particulars. PRIMARY PRODUCTS POOLS ACT [ASSENTED TO 12TH NOVEMBER, 1923.] AMENDMENT ACT OF 1923. BE it enacted by the King's Most Excellent Majesty,. by and with the advice and consent of the Legis. lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title 1. This Act may be cited as " The Primary Productg and t t' Pools Act Amendment Act of 1923" and shall be read as ~ ~ ~ c~ c IOn one with *" The Primary Products Pools Act of 1922," herein referred to as the Principal Act. The Principal Act and this Act may oe cited together as "The Primary Products Pools Acts, 1922 to 1923." Amendment 2. In the definition of "commodity" in section two of s. 2. of the Principal Act, after the words "dairy produce" the words " (including butter and cheese) and -eggs" are inserted. In the definition of "grower" in the said section, after the word "grown" where it twice occurs the words "or produced" are respectively inserted. Amendment 3. In subsection one of section three of the Principal of 8.3. Act, after the words "dairy produce" the words "(including butter and cheese) or eggs" are inserted. The first paragraph of subsection three of the said section is repealed and the following provision is inserted in lieu thereof :- " Notice of intention to make such Order shall be published in the Gazette and in the Queensland Producer or other official organ of the Council of Agriculture or * 13 Geo. Primary Products Pools Act Amendment Act. in at least one other newspaper circulating in the district or locality to which the Order in Council is intended to apply at least thirty days before the making of such Order. Secretaries of District Councils in the district or districts concerned must be notified in writing at least thirty days before the making of such Order, with instructions to notify secretaries of Local Producers' Associations in their districts." The following provision is added to the said sub- section :- "The expenses of such poll shall be borne by the Council of Agriculture in the first instance, and if an Order in Council is made pursuant to such poll such Council shall be reimbursed such expenses by means of a levy or levies, as prescribed, made in respect of the commodity with respect to which the poll has been taken." 4. In subsection one of section four of the Principal Amendment', Act, after the words "as prescribed" the words of 8. 4. "together with a person to represent the Council of Agriculture" are inserted. Also the words "appoint one of them" are repealed and the words "on the recommendation of the Council of Agriculture appoint one of them" are inserted in lieu thereof. 5, The following provision is added to section five Amend.ment. of the Principal Act :_ of 11. 5. " The Board may for the purposes of this Act from time to time exercise all or any of the following powers :- (a) Purchase, contract for the me of, or otherwise provide and hold any land which may be required by the Board, and any personal. property whatsoever; (b) Contract for the use of or erect or otherwise provide any buildings or structures, and repair, equip, furnish, and maintain the· same; (c) Dispose of any property held by it under the foregoing provisions in paragraphs (a) and (b) contained, for such price and on such terms. and conditions as to the Board seem proper.'"

The amendments of the Principal Act made by this Act shall be deemed to have come into operation on the first day of January, one thousand nine hundred and twenty-three, and the Principal Act shall be construed accordingly : Provided that the expenses of any poll taken under the Principal Act prior to the passing of this Act shall not be collected by means of a levy or levies as herein provided. 14 Geo. E it enacted by. the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short titk 1. This Act may be cited as " The Fruit Marketing Organisation Act of 1923." Definitions. 2. In this Act, unless the context otherwise indicates, the following terms have the meanings set against them respectively, that is to say:- Citrus fruit. "Citrus fruit" -Citrons, grape-fruit, lemons, times, mandarins, oranges, sevilles, and any other fruit grown in Queensland declared by the Governor in Council, by notification in the Gazette, to be citrus fruit within the meaning of the Act; Committee of Direction. "Committee of Direction"-The Committee of Direction constituted under this Act; Deciduous fruit. "Deciduous fruit"-Apples, apricots, cherries, grapes, nectarines, peaches, pears, plums, quinces, and any other fruit grown in Queens- land declared by the Governor in Council, by notification in the Gazette, to be deciduous fruit within the meaning of the Act; Fruit,. " Fruit "-Bananas, pineapples, deciduous fruits, citrus fruits, and other fruits, or any fruit grown in Queensland declared by the Governor in Council, by notification in the Gazette, to be fruit within the meaning of the Act;
