An Act to Amend "The Primary Producers' Organ- THE PRIMARY isation and Marketing Acts, 1926 to 1941," PRODUOERS' ORGANISATION in certain particulars. AND MARK]'TING AOTS [ASSENTED TO 20TH DECEMBER, 1946.] AMENDMENT B ACT OF 1946. E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as "The Primary : ~ ~ struction Producers' Organisation and Marketing Acts Amendment . Act of 1946," and shall be read as one with *" The Primary Producers' Organisation and Marketing Acts, 1926 to 1941," herein referred to as the Principal Act. Collective The Principal Act and this Act may be collectively title. cited as "The Primary Producers' Organisation and Marketing Acts, 1926 to 1946." New s. 9A inserted. Northern Pig Board. Amendments of the Principal Act. 2. The following section is inserted after section nine of the Principal Act, namely:- "[9A.] (1.) The Northern Pig Board shall be deemed to be and to have always been constituted in relation to that part of the commodity known as pigs which consists of the carcass or any part of the carcass of a pig grown or produced or prepared in the area (inclusive of the Petty Sessions District of Innisfail) described in the Order in Council of the seventh day of January, one thousand nine hundred and twenty-six, in the same manner and to the same extent as if the carcass or any part of the carcass of every such pig had been specifically declared by such Order in Council to be a commodity under and for the purposes of this Act and such Order in Council had constituted such Board in relation thereto. Such Order in Council and every subsequent Order in Council amending such Order in Council or declaring, from time to time, that the Northern Pig Board should continue to function for the several extended terms respectively set forth in such subsequent Orders in Council and the provisions of this Act (with such modifications thereof or additions thereto as have been made by any such Order in Council) shall apply and * 17 G. 5 No. 20 and amending Acts.

Primary PrOdtlCers' Organisation, Etc., Act. extend, and it is hereby declared always have applied and extended, to every such carcass or part of the carcass of any pig, and the Northern Pig Board and all persons, things, and matters concerned, and every such Order in Council is hereby approved, ratified, and validated accordingly. (2.) The Petty Sessions District of Innisfail is, and it is hereby declared always was, included in the area comprising the Petty Sessions Districts specified- (i.) In the Order in Council dated the seventh day of January, one thousand nine hundred and twenty-six, whereby pigs grown in such area by any person keeping pigs at any time during the existence of the Board constituted by such Order in Council were declared to be, for the period specified in such Order in Council, a commodity under and for the purposes of this Act, and whereby a Board was constituted under the name of the Northern Pig Board in relation thereto; or (ii.) In any subsequent Order in Council amending such Order in Council or declaring, from time to time, that the Board constituted by such firstmentioned Order in Council should continue to function for the several extended terms respectively set forth in such subsequent Orders in Council, and every such Order in Council shall be read and construed, and it is hereby declared always was to be read and construed, by substituting the word" Innis- fail" for the word "Mourilyan" wherever such last- mentioned word occurs therein (and is hereby approved, ratified, and validated accordingly)." 3 (1.) Subsection three of section eleven of the Amendment Principal Act is amended by inserting before the words of s. 11. "and shall have the powers" the words "or, if the Board has power to undertake the functions ofmarketing the commodity for which it is constituted, "The (Name of Oommodity) Marketing Board" "; and the said sub- section is further amended by inserting after the first paragraph thereof the following paragraph, namely :- " Moreover if any Board is constituted for a district or locality its name shall include a word or words indicating such district or locality."

(a) The name of every Board subsisting at the passing of this Act which has power to undertake the functions of marketing the commodity for which it was constituted shall be and be deemed to be changed to "The (Name of Oommodity for which such Board was constituted) Marketing Board." (b) Any reference in any Act, Proclamation, Order in Council, or regulation, or in any mortgage, lien, security, bond, debenture, agreement, contract, deed, or other document, instrument, or writing whatsoever to any such Board shall be read and construed as if the new name of such Board appeared therein on and from the date of the passing of this Act instead of its old name, and shall operate and take effect accordingly. (c) The change of the name of any such Board made by paragraph (a) of this subsection shall not affect the continuity of its identity, or any of its rights and obligations, nor render defective any legal proceedings by or against it, and any legal proceedings that might have been commenced or continued by or against it by its former name may be commenced or continued against it by its new name. News.29B 4. The following section, numbered 29B, is inserted inserted. after section 29A of the Principal Act, namely : - Superannua. "[29B.] Every Board shall have and it is hereby etimopnlofyoer es. adnecoltahreerdBaolwaradysorhoadtheprowBeorar(desi) thteor easltoanbelioshr ajonidntsluypwpoitrht or aid in the establishment and support of such super- annuation or provident schemes or plans or trusts as may be approved by the Minister for the benefit of its or their employees and their dependants and to subsidise and to contribute and make payments from the funds of the Board (excepting moneys derived from levies which are applicable only for the respective purposes for which the levies were imposed) to the funds created and held in connection with any such schemes, plans, or trusts. For the purposes of this section the Council, the State Wheat Board, and the Brisbane Milk Board, constituted under *" The Milk Supply Act of 1938," shall each be deemed to be respectively a Board. Moreover the Committee of Direction of Fruit Marketing shall, as respects joint action with any other Board or Boards, be deemed to be a Board. * 2 G. 6 No. 27.

Where two or more Boards are acting jointly under the authority of this section, such Boards may make arrangements with the Council for the management by the Council of, and (subject to the making of such arrange- ments) the Council shall manage under and in compliance with such arrangements, their superannuation or provident scheme or plan or trust." 5. Subsection 7A of section thirty of the Principal Amendment Act is amended by adding the following paragraph of s. 30 (7A). thereto, namely :- "Moreover, the Queensland Cane Growers' Council shall in its corporate name have power to purchase, sell, take on lease, lease, exchange, and hold land as trustee for any district cane growers' executive upon trust for all or any of the objects and purposes of such executive."
