An Act to Amend" The Primary Producers' Organ- THE PRIMARY isation and Marketing Acts, 1926 to 1938," PRODUCERS' ORGANISATION AND in certain particulars, and for other purposes. MARKETING ACTS AMENDMENT [ASSENTED TO 1 ST DECEMBER, 1939.] ACT OF 1939. B E it enacted by the King's Most Excellent Majesty, by arid with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows;- Short title. Collective title. 1. This Act may be cited as" The Primary Producers' Organisation and Marketing Acts Amendment Act of 1939," and shall be read as one with *" The Primary Producers' Organisation and Marketing Acts, 1926 to 1938," herein referred to as the Principal Act. The Principal Act and this Act may be collectively cited as "The Primary Producers' Organisation and Marketing Acts, 1926 to 1939." Amendment 3. (1.) Section four of the Principal Act is amended ofa.4. as follows;- (a) Subsection eight thereof is repealed and the following new subsection eight is inserted in lieu thereof, namely;- President "(8.) The Council shall at its first meeting held aPnredsiDdeenptu.ty after each election of members elect one of its members to be President. The Council shall elect another of its members to be Deputy President during each year of its tenure of office. * 17 Geo. V. No. 20.and amending Acts, 8upra, pages 11659 et 8eq.
PRIMARY PRODUCE. 17731 1939. Primary Producers' Ot'ganisation, Etc., Act. The Deputy President for the first year shall be elected at the first meeting of the Council held after each election, and the Deputy President for each subsequent year shall be elected at the first meeting of the Council held during that year. In the absence of the President and Deputy President from any meeting the Council shall elect a member of the Council to act as President for the meeting." (b) In subsection thirteen thereof the words" and five" are repealed and the words" the Deputy President for the time being, the Director of Marketing, and three" are inserted in lieu of such repealed words, and the words "and Deputy President for the time being and the Director of Marketing" are inserted after the words "other than the President." In addition the following paragraph is added to the said subsection thirteen, namely;- "Notwithstanding anything' contained in this sub- section, no commodity shall be represented by more than one member upon the Executive." .' (c) The words "except as hereinafter provided" are inserted after the words "Council shall" in the first para- graph of subsection fifteen thereof and the following proviso is added to the said subsection fifteen, namely ;- "Provided further, that every Board shall pay to its respective representative or representatives the fees and/or allowances so fixed for attendance by him or them at meetings of the Council." (2.) The person in office at the passing of this Act I~ terpreta. as Deputy President and a member of the Executive ! l~ ~ : Jments Committee of the Council of Agriculture shall be deemed to s. 4. to hold both such offices under the Principal Act as amended by this Act. 4. Section nine of the Principal Act is amended as Amendment follows ;_ of s. 9. (a) The words and brackets" (including the carcass or any part of the carcass of a pig) " are inserted after the word "pigs" in subsection one thereof. (b) The last paragraph of subsection five thereof is repealed.
17732 PRIMARY PRODUCE. Primary Producers' Organisation, Etc., Act. 3 GEO. VI, No. 21,1939. Amendment 5. In paragraph (iv.) of section thirteen of the of s. 13. Principal Act the words " the Butter Board, the Cheese Board" are repealed and the words "the Council of Agriculture" are inserted in lieu of such repealed words. Amendment 6. The following new subsection four is added to of S. 14A. section 14A of the Principal Act, namely:- " (4.) Any Board within the meaning of this section may apply to the Auditor-General for exemption from complying with subsection one of this section or for a limitation of its obligation to insure and keep itself insured in terms of the said subsection one. The Auditor-General maymake suchrecommendation respecting such application as he shall think fit to the Minister, who shall refer same to the Governor in Council. Subject to a recommendation by the Auditor- General in that behalf,· the Governor in Council may from time to time by Order in Council exempt any Board within the meaning of this section from complying with subsection one of this section or may limit the obligation of any such Board to insure and keep itself insured in terms of the said subsection one to an amount stated in such Order in Council : Provided that the Governor in Council may by a later Order in Council repeal or modify any Order in Council made under this subsection." -Amendment 7. The last subsection of section thirty of the of s. 30. Principal Act (being the subsection beginning with the words " The Governor in Council" and ending with the words" sugar industry") is renumbered subsection nine. Amendment 8. Sub-paragraph (a) of paragraph (ii.) of subsection OfB.33. one of section thirty-three of the Principal Act is repealed. PROTECTION OF ABORIGINALS. See ABORIGINALS. REGULATION OF MINES. See MINING.
