Primary Producers' Organisation and Marketing Acts, 1926 to 1930." The Principal Act and this Act may collectively be cited as "The Primary· Producers' Organisation and Market£ng Acts, 1926 to 1932." Amendments of the Principal Act. 2. Section four of the Principal Act is amended Amendment by the deletion of the second, third, and fourth paragraphs of s. 4. of subsection one (being all words from and including the words "The number of" to and including the words "as the case may be"), and by the insertion in lieu thereof of the following words, namely:- " The number of members of the Council shall be the number from time to time declared by the Governor in Council by Order in Council. The Director of Marketing appointed under this Act shall by virtue of his office, but without further remuneration other than that attaching to his office as a member, be a member of the Council. The Council shall be constituted in the manner following :- (a) The Director of Marketing; (b) Members elected from amongst the members of Boards in such manner and in such number as may be prescribed. No. 31, purpose of this provision the Committee of Direction constituted under *" The Fruit Marketing Organisation Acts, 1923 to 1930," shall be deemed to be a Board, and the State Wheat Board shall be deemed to be a Board. Such members shall hold office as from the dates of their appointment by the respective Boards until the termination of the period as members of such Boards, and such members shall be eligible for re-election or reappointment as the case may be; (c) One representative for each of the nine districts as embrace local producers' associations registered under this Act as may from time to time be prescribed. Such representatives shall be appointed or elected in the manner prescribed." The Council as constituted under the Principal Act shall continue in office until the Council to be constituted under the Principal Act, as amended by this Act, shall be so constituted. Amendment 3. A new paragraph ~ vi. ) is added to subsection of s. 8. five of section eight of the Principal Act, as follows : - "(vi.) Such other functions as may from time to time be prescribed." Amendment 4. Subsection nine of section nine of the Principal of s. 9. Act is amended by inserting after the word "made" the words" or purporting to be made." Amendment 5. A new subsection (4A) is inserted after subsection of s. 11. four of section eleven of the Principal Act, namely:- "(4A.) A Board member shall vacate his seat if he absents himself from three consecutive meetings of the Board without the consent in writing of the chairman." Amendment 6. Section fourteen of the Principal Act is amended of s. 14. as follows:- (a) Paragraph (i.) is repealed and the following new paragraphs are inserted in lieu thereof, namely:- " (i.) Appoint, employ, or authorise such officer, serv-ant, and other persons as are necessary; and * 14 Geo. V. No. 39 and amending Acts, supra, page 10766.

Appoint, employ, or authorise such agents as are deemed necessary and imposing such conditions of agency as the Board may deem proper, or as may be approved, or as may be prescribed," and paragraphs (ii.), (iii.) (iv.), and (v.) are renumbered (iii.), (iv.), (v.), and (vi.) respectively. (b) A new paragraph is added to the said section, namely:- "(vii.) Notwithstanding any Act or law to the contrary, take no cognizance of, nor be compellable to pay any order given by any grower of the commodity to pay to any person other than the Crown (or corporation or instrumentality representing the Crown) any portion of the moneys due to such grower on account of the commodity by such Board." 7. Section eighteen of the Principal Act is amended Amendment as follows :_ of s. 18. (a) In subsection three the word" and," appearing before the words "all expenditure," is deleted; also, after the word "commodity," where it lastly occurs in the subsection, the words " and generally the method of the determining of and actually what is the net price" are inserted. (b) A new subsection five is added to the said section as follows :- "(5.) The Board may, with the prior consent of the Minister, deduct from the net proceeds of sales of the commodity an amount not to exceed two per cent. of the aggregate net realisations for anyone year. The moneys thus obtained shall be placed to the credit of a Working Account Reserve Fund, and this Fund may be drawn upon in connection wIth the conduct of the Board's busmess in manner approved or prescribed."
