s1 2 s3 Primary Producers’ (Levy on Cane Growers) No. 74, 1999 Amendment (No. 1) ˙ Short title 1. This regulation may be cited as the Primary Producers’ (Levy on Cane Growers) Amendment Regulation (No. 1) 1999 . ˙ Regulation amended 2. This regulation amends the PrimaryProducers’(LevyonCaneGrowers) Regulation 1997 . ˙ Insertion of new s 12A 3. Part 3, division 2, after section 12— insert— ˙ ‘ Loan repayment levy by Victoria Mill Suppliers’ Committee ‘ 12A.(1) The Victoria Mill Suppliers’ Committee may make a particular levy on growers in its district mentioned in schedule 9, column 1 who hold land mentioned in schedule 9, column 2. ‘ (2) The levy for the 1998 crushing season is at the rate stated in schedule 9, column 3 for sugar cane grown on the land by the grower and supplied to the mill. ‘ (3) The levy for each of the 1999 to 2002 crushing seasons is at the rate stated in schedule 9, column 4 for sugar cane grown on the land by the grower and supplied to the mill. ‘ (4) The amount raised by the levy may only be spent on loan repayments in relation to— (a) a payment to the Department of Main Roads for the construction of— (i) a 4.5 km railway across the Bruce Highway at Grasso’s Road, along Grasso’s Road and Cassius Road to Pappins Road; and (ii) an associated highway overpass; or (b) a payment to a grower mentioned in subsection (1) for an

s4 3 s6 Primary Producers’ (Levy on Cane Growers) No. 74, 1999 Amendment (No. 1) easement granted to the mill owner under the Sugar Industry Act1991 , section 196, 1 for the construction of the railway.’. ˙ Amendment of s 13 (How unused funds are to be applied) 4. Section 13(2)— omit, insert— ‘ (2) Despite sections 7 to 12A— (a) for a levy made other than under section 12A—the balance may be spent on administrative purposes in the interest of the growers on whom the levy was made; or (b) for a levy made under section 12A—the balance must be rebated to the growers on whom the levy was made. ‘ (3) For subsection (2)(b), the balance must be rebated to the growers in proportion to the amount of levy paid by each grower.’. ˙ Amendment of s 14 (When levy may be made) 5. Section 14, ‘6 June 1998. 3 ’— omit, insert— ‘— (a) for a levy made other than under section 12A—6 June 1998; or (b) for a levy made under section 12A—14 May 1999. 2 ’. ˙ Amendment of s 15 (Request to hold a poll) 6. Section 15, ‘5 June 1998. 4 ’— omit, insert— 1 Section 196 (Grant of easement) of the Sugar Industry Act 1991 . 2 However, under section 30(8A)(bf) (Cane to be a commodity) of the Act, a body must not make a levy if a poll is held and the majority of votes is against the making of the levy.
