s1 2 s3 Primary Producers’ (Levy on Cane Growers) No. 323, 1995 Amendment (No. 1) ˙ Short title 1. This regulation may be cited as the Primary Producers’ (Levy on Cane Growers) Amendment Regulation (No. 1) 1995 . ˙ Regulation amended 2. This regulation amends the PrimaryProducers’(LevyonCaneGrowers) Regulation 1995 . ˙ Insertion of new s 13A 3. After section 13— insert— ˙ Millaquin Mill Suppliers’ Committee particular levy 13A.(1) With the consent of the Queensland Cane Growers’ Council, the Millaquin Mill Suppliers’ Committee may make a particular levy on a grower who, during the 1995 crushing season— (a) supplied sugarcane to its mill from land assigned to the mill; and (b) held an underground water allocation under the Water ResourcesAct 1989 . (2) The levy is 4 cents per tonne of the sugarcane supplied. (3) However, if the grower used water other than underground water to grow any of the sugarcane supplied, the levy is reduced proportionately by the percentage of the grower’s total water allocation that was not underground (the “percentage” ). (4) The percentage is set out in the schedule of cane grower underground water allocation holders—Millaquin Mill area, held by the Bundaberg District Cane Growers’ Executive. 1 (5) Subject to section 14, the committee may only spend the levy to 1 The schedule is available for inspection, free of charge, at the Bundaberg District Cane Growers’ Executive at 32 Bourbong Street, Bundaberg.
s4 3 s5 Primary Producers’ (Levy on Cane Growers) No. 323, 1995 Amendment (No. 1) conduct a feasibility study of a regulating structure, on the Elliott River, that is designed to enhance the recharge of the underground aquifer.’. ˙ Amendment of s 15 (Limitation on power to make certain particular levies) 4.(1) Section 15(1)— omit, insert— 15.(1) A body authorised to make a particular levy under part 3 (other than section 13 2 ) may make the levy from— (a) for a levy under section 13A 3 —18 December 1995; or (b) otherwise—22 June 1995.’. ˙ Amendment of s 16 (Request to hold a poll) 5.(1) Section 16(3)— omit, insert— (3) A request must be sent to the Minister by— (a) for a levy under section 13A—15 December 1995; or (b) otherwise—19 June 1995.’.
