96 Qlzursfitnbr ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE No. 11 of 1976 An Act to amend the Primary Producers ' Assistance Act 1972-1974 in certain particulars [ASSENTED TO 2ND APRIL, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Primary Producers' Assistance Act Amendment Act 1976. (2) The Primary Producers' Assistance Act 1972-1974 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Primary Producers' Assistance Act1972-1976.
Primary Producers ' Assistance Act Amendment Act 1976, No. 11 97 2. Amendment of s, 2 . Section 2 of the Principal Act is amended by- (a) inserting after the definition " Corporation " the following definition:- " " dairy factory " means a factory engaged in manufacturing processing or marketing dairy produce within the meaning of the Dairy Produce Act 1920-1974;"; (b) omitting the definition " Marginal Dairy Farms Reconstruction Scheme ". 3. Amendment of s. 4. Section 4 of the Principal Act is amended by- (a) in subsection (2), in subparagraph (b), inserting after the word " farmers " the words " or owners of dairy factories "; (b) in subsection (3), in subparagraph (a), inserting after the word " farmers." the words " or owners of dairy factories ". 4.. Repeal of and new s. 5 . The Principal Act is amended by repealing section 5 and substituting the following section:- " 5. Assistance that may be given under Act. (1) Subject to this Act, the Corporation- (a) may make advances to or for the benefit of any farmer for all or any of the following purposes:- (i) to,restructure in any manner an uneconomic farm; (ii) to acquire other land and improvements in the name of the farmer to be used by him for farming independently of,or in conjunction with a farm; (iii) to transfer to and re-establish on land so acquired all or any of the operations of a farm; (iv) to purchase livestock, plant or equipment for a farm ; (v) to restructure, improve or replace improvements, plant-,or equipment on a farm; (vi) to carry' out property development on a farm; (vii) to finance changes in the ownership of a farm where the Corporation in its discretion determines that- (A) it is in the interests of economic farming operations to do so; or (B) it is desirable that the farm or an interest therein be transferred to a spouse, child, parent, brother, sister, nephew or niece of the farmer; (b) may make advances to any owner of a dairy factory for the purpose of meeting the whole or a part of the costs incurred by him after Ist July 1973 in connexion with alterations (including structural alterations) made, vehicles purchased and plant and equipment purchased and installed after that date being alterations, vehicles, plant and equipment- (i) that were required to provide adequate facilities for the supply of wholemilk as refrigerated bulk milk to the factory or the receipt, storage or processing
98 Primary Producers' Assistance Act Amendment Act 1976, No. 1 1 of the wholemilk at the factory, in consequence of suppliers of wholemilk having commenced, whether before or after the passing of this Act, to supply wholemilk to the factory as refrigerated bulk milk; or (ii) that the Corporation is satisfied are required to provide adequate facilities of a kind specified in subparagraph (i) for the purpose of enabling suppliers of wholemilk to the factory to commence to supply wholemilk to the factory as refrigerated bulk milk. (2) The assistance specified in subsection (1) shall not be given unless the Corporation is satisfied that the owner to be assisted has been unable to obtain an advance on reasonable terms from normal financial sources for the purposes for which the assistance is to be given. (3). In this section, a reference to the processing of wholemilk includes a reference to- (a) cooling, testing, grading or pasteurising wholemilk or treating wholemilk in any other manner; (b) putting wholemilk into bottles, cartons or other containers; and (c) the manufacture of any product derived from wholemilk. 5. New s. 5A. The Principal Act is amended by inserting after section 5, as inserted by this Act, the following section:- " 5A. Powers of Corporation in respect of other funds. Where at any time a fund other than that specified in this Act is established at the Treasury pursuant to a scheme to extend assistance to farmers generally or of a particular class and the Corporation is charged with the administration of that scheme, the provisions of this Act that apply with respect to securing assistance to farmers generally apply (and it is declared always have applied) with all necessary adaptations with respect to securing assistance pursuant to the scheme.". 6. Amendment of s. 6. Section 6 of the Principal Act is amended by, in subsection (1), inserting after the word " farmer " the words " or owner of a dairy factory ". 7. Amendment of s. 7. Section 7 of the Principal Act is amended by, in subsection (3), in subparagraph (b), inserting after the word " farm " the words " or dairy factory ". 8. Amendment of s. 8. Section 8 of the Principal Act is amended by- (a) in subparagraph (b), omitting the word " prescribed " and substituting the words " fixed by Order in Council "; (b) in subparagraph (c), omitting the word " twenty " and substituting the word " twenty-five ".

Section 11 of the Principal Act is amended by, in subsection (1), in subparagraph (b), inserting after the word " farmer " the words " or owner of a dairy factory ".
