Primary Industries Levies and Charges (Nursery Products) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, and having taken into consideration relevant recommendations made to the Minister by the Australian Horticultural Corporation and the Horticultural Research and Development Corporation, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991 and the Horticultural Levy Act 1987.

1.   Commencement

1.1   These Regulations commence on 1 July 1995.

2.   Amendment

2.1   The Primary Industries Levies and Charges (Nursery Products) Regulations are amended as set out in these Regulations.

3.   Regulation 1 (Citation)

3.1   After “Charges”, insert “Collection”.

4.   Regulation 8 (How much levy is payable?)

4.1   Omit the regulation, substitute:

How much levy is payable?

“8.

(1) The rate of levy for the purposes of section 8 of the Levy Act is 3.4% of the amount for which containers are sold, being the last sale to which subsection 9 (2) of the Collection Act applies before nursery products are placed in the containers.

“(2)

The rate of levy for the purposes of section 9 of the Levy Act is 1.6% of the amount for which containers are sold, being the last sale to which subsection 9 (2) of the Collection Act applies before nursery products are placed in the containers.”.

5. Repeal of Primary Industries Levies and Charges Collection (Nursery Products) Regulations (Amendment)

5.1   Statutory Rules 1995 No. 121 are repealed.
