Primary Industries Levies and Charges (National Residue Survey Levies) Regulations 19982(Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the National Residue Survey (Excise) Levy Act 1998.

1.   Commencement

1.1   These Regulations commence on 3 July 1998.

2.   Amendment

2.1   The Primary Industries Levies and Charges (National Residue Survey Levies) Regulations 1998 are amended as set out in these Regulations.

3.   Regulation 240 (Rate of NRS excise levy on sheep and lamb transactions if value assigned (NRS Excise Levy Act, Schedule 15, clause 3))

3.1   Subregulation 240 (6):

Omit “Subregulation (1), (2) or (3)”, substitute “Subregulation (3), (4) or (5)”.

Note   Omit Notes 1 and 3 after regulation 240.

4.   New regulation 241

4.1   After regulation 240, insert:

Rate of NRS excise levy on other sheep and lamb transactions etc (NRS Excise Levy Act, Schedule 15, clause 3)

 “241.(1) The rate for subclause 3 (1) of Schedule 15 to the NRS Excise Levy Act is 1.8 cents per head for:

  • (a)

    a sheep transaction to which none of subregulations 240 (3), (4) and (5) apply; or

  • (b)

    a delivery or slaughter of sheep mentioned in paragraph 2 (1) (b), (c) or (d) of that Schedule.

 “(2) The rate for subclause 3 (1) of Schedule 15 to the NRS Excise Levy Act is 4.7 cents per head for:

  • (a)

    a lamb transaction to which none of subregulations 240 (3), (4) and (5) apply; or

  • (b)

    a delivery or slaughter of lambs mentioned in paragraph 2 (1) (b), (c) or (d) of that Schedule.”.
