Primary Industries Levies and Charges

Collection (Wheat) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Wheat Industry Fund Levy Act 1989 and the Primary Industries Levies and Charges Collection Act 1991.

1.   Commencement

1.1   These Regulations commence on 1 October 1993.

2.   Amendment

2.1   The Primary Industries Levies and Charges Collection (Wheat) Regulations are amended as set out in these Regulations.

3.   Regulation 4 (What is the sale value of wheat?)

3.1   Subregulation 4 (1):

Omit “section 6”, substitute “the definition of ‘value’ in subsection 4A (1)”.

3.2   New paragraph 4 (1) (aa):

Before paragraph 4 (1) (a), insert:

  • “(aa)

    in the case of seed wheat for sowing—the amount that would constitute the sale price of the wheat if it were not seed wheat for sowing and had been sold at the market price prevailing on the day the wheat was delivered as mentioned in section 5 of the Levy Act; and”.

3.3   Subparagraph 4 (1) (b) (ii):

Omit the subparagraph, substitute:

  • “(ii)

    if there are no sales invoices or documents of that kind—the amount that would constitute the sale price of the wheat if that wheat had been sold at the market price prevailing on the day the wheat was processed, or delivered, as mentioned in section 5 of the Levy Act.”.

4.   Regulation 8 (When is levy due for payment?)

4.1   New paragraph 8 (aa):

Before paragraph 8 (a), insert:

  • “(aa)

    seed wheat for sowing; or”.
