Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991 and the National Residue Survey Administration Act 1992.

Citation

1. These Regulations may be cited as the Primary Industries Levies and Charges Collection (National Residue Survey—Pig) Regulations.

Commencement

2. These Regulations commence on 1 July 1993.

Incorporation

3. These Regulations are incorporated and must be read as

one with the Pig Levy Collection Regulations.

Interpretation

4. In these Regulations, unless the contrary intention

appears:

Levies and Charges Collection (Pig) Regulations2;

"Pig Levy Collection Regulations" means the Primary Industries

"NRS Administration Act" means the National Residue Survey

Administration Act 1992;

"NRS Levy Act" means the National Residue Survey (Livestock

Slaughter) Levy Act 1992;

"NRS levy" means levy imposed on the slaughter of pigs under the

NRS Levy Act and payable under section 9 of the NRS

Administration Act.

5. The NRS Levy Act is prescribed for the purposes of the

definition of "levy" in section 4 of the Collection Act.

What is the rate of NRS levy?

6. For the purposes of section 9 (2) of the NRS

Administration Act, the rate of NRS Levy payable on the slaughter

of pigs is 8.5 cents per head.

Who is a processor?

7. Pigs are a collection product to which paragraph (b) of the definition of "processor" in subsection 4 (1) of the Collection Act applies.

When is NRS levy due for payment?

8. For the purposes of section 6 of the Collection Act, NRS

levy is due for payment on the last day for lodging a return for the

pigs under the Pig Levy Collection Regulations.

[NOTE: For penalty see section 15 of the Collection Act]

Liability of processor as intermediary

9. Pigs are a product to which paragraph 7 (2) (b) of the

Collection Act applies.

Additional information in returns

10. In addition to complying with the Pig Levy Collection Regulations, a person who lodges a return under those Regulations must include in the return particulars of the total amount of NRS levy payable by the person on the slaughter of the pigs to which the return relates.
