Primary Industries Levies and Charges Collection (National Residue Survey—Oilseeds) Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991 and the National Residue Survey Administration Act 1992.

Citation

 1. These Regulations may be cited as the Primary Industries Levies and Charges Collection (National Residue Survey—Oilseeds) Regulations.

Commencement

 2.These Regulations commence on 1 July 1996.

Interpretation

 3.(1)In these Regulations, unless the contrary intention appears:

“NRS levy” means National Residue Survey Levy;

“Oilseeds Levy Collection Regulations” means the Primary Industries Levies and Charges Collection (Oilseeds) Regulations;

“value”, in relation to leviable oilseeds, has the meaning it has in the Oilseeds Levy Act 1977.

 (2) An expression used in these Regulations and in the Oilseeds Levy Collection Regulations has the same meaning in these Regulations as it has in the Oilseeds Levy Collection Regulations.

NRS levy

 4. The National Residue Survey (Oilseeds) Levy Act 1992 is prescribed for the purposes of the definition of “levy” in subsection 4 (1) of the Primary Industries Levies and Charges Collection Act 1991.

What is the rate of NRS levy on oilseeds?

 5. For the purposes of paragraph 9 (2) (b) of the National Residue Survey Administration Act 1992, the rate of NRS levy payable on leviable oilseeds is:

  • (a)

    for rape seed of a variety commonly known as canola—0.015% of the value of the rape seed; or

  • (b)

    for any other oilseeds—nil.

When is NRS levy due for payment?

 6. For the purposes of section 6 of the Primary Industries Levies and Charges Collection Act 1991, NRS levy imposed on leviable oilseeds is due for payment:

  • (a)

    on the day on which a return under regulation 8 of the Oilseeds Levy Collection Regulations is lodged for the oilseeds; or

  • (b)

    if the return is not lodged within the period provided under regulation 7 of the Oilseeds Levy Collection Regulations—on the last day of that period.

Additional information in returns

 7. In addition to complying with the Oilseeds Levy Collection Regulations, a return lodged by a person under those Regulations must include particulars of the total amount of NRS levy payable on the oilseeds to which the return relates.
