Primary Industries Levies and Charges Collection (National Residue Survey—Honey) Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991 and the National Residue Survey Administration Act 1992.

Citation

 1. These Regulations may be cited as the Primary Industries Levies and Charges Collection (National Residue Survey—Honey) Regulations.

Commencement

 2. These Regulations commence on 1 January 1998.

Interpretation

 3.(1)In these Regulations:

“Honey Levy Collection Regulations” means the Primary Industries Levies and Charges Collection (Honey) Regulations;

“NRS Export Levy Act” means the National Residue Survey (Honey Export) Levy Act 1992;

“NRS levy” means National Residue Survey Levy;

“NRS Levy Act” means the National Residue Survey (Honey) Levy Act 1992.

 (2) An expression used in these Regulations and in the Honey Levy Collection Regulations has the same meaning in these Regulations as in those Regulations.

NRS levy

 4.The NRS Levy Act and the NRS Export Levy Act are prescribed for the purposes of the definition of “levy” in subsection 4 (1) of the Collection Act.

What is the rate of NRS levy on honey?

 5. For paragraph 9 (2) (b) of the National Residue Survey Administration Act 1992, the rate of NRS levy payable on honey is 0.25 cents a kilogram.

When is NRS levy due for payment?

 6. For section 6 of the Collection Act, NRS levy imposed on honey is due for payment:

  • (a)

    on the day when a monthly return mentioned in regulation 9 of the Honey Levy Collection Regulations is lodged for the honey; or

  • (b)

    if the return is not lodged within the period stated in regulation 9 of those Regulations—on the last day of that period.

Additional information in returns

 7. As well as complying with the Honey Levy Collection Regulations, a return lodged by a person under those Regulations must include particulars of the total amount of NRS levy payable on the honey to which the return relates.
