Primary Industries Levies and Charges Collection (National Residue Survey—Grain Legumes) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991 and the National Residue Survey Administration Act 1992.

1.   Commencement

1.1   These Regulations commence on 1 July 1996.

2.   Amendment

2.1   The Primary Industries Levies and Charges Collection (National Residue Survey—Grain Legumes) Regulations are amended as set out in these Regulations.

3.   Regulation 4 (Interpretation)

3.1   Definition of “NRS levy”:

Omit the definition, substitute:

‘NRS levy’ means National Residue Survey Levy;”.

3.2   Definition of “Grain Legumes Levy Collection Regulations”:

Omit the definition, substitute:

‘Grain Legumes Levy Collection Regulations’ means the Primary Industries Levies and Charges Collection (Grain Legumes) Regulations;”.

3.3   Insert the following definition:

‘value’, in relation to leviable grain legumes, has the meaning it has in the Grain Legumes Levy Act 1985.”.

4.   Regulation 6 (What is the rate of NRS levy on lupins and field peas?)

4.1   Omit the regulation, substitute:

What is the rate of NRS levy on lupins, field peas and chickpeas?

 “6. For the purposes of paragraph 9 (2) (b) of the NRS Administration Act, the rate of NRS levy payable on leviable grain legumes that are:

  • (a)

    the seeds of lupins; or

  • (b)

    the seeds of field peas; or

  • (c)

    the seeds of chickpeas (Cicer arietinum);

is 0.015% of the value of the grain legumes.”.

5.   Regulation 7 (When is NRS levy due for payment?)

5.1   Omit the regulation, substitute:

When is NRS levy due for payment?

 “7. For the purposes of section 6 of the Collection Act, NRS levy imposed on leviable grain legumes is due for payment:

  • (a)

    on the day on which a quarterly return under regulation 8 of the Grain Legumes Levy Collection Regulations is lodged for the grain legumes; or

  • (b)

    if the quarterly return is not lodged within the period provided under regulation 7 of the Grain Legumes Levy Collection Regulations—on the last day of that period.

[NOTE:   For penalty, see section 15 of the Collection Act.]”.
