Primary Industries Levies and Charges Collection (Macadamia Nut) Regulations2 (Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991, the Horticultural Export Charge Act 1987 and the Horticultural Levy Act 1987.

1.   Commencement

1.1 These Regulations commence when Schedule 2 to the National Residue Survey Administration Amendment Act 1998 commences.

Note   That Schedule commences on 3 July 1998.

2.   Amendment

2.1   The Primary Industries Levies and Charges Collection (Macadamia Nut) Regulations are amended as set out in these Regulations.

3.   Regulation 4 (Definitions)

3.1   Definitions of NRS levy and NRS Levy Act:

Omit the definitions.

4.   Regulation 9 (Grower—producer)

4.1   Omit “for the purposes of paragraph (b)”, substitute “for paragraphs (b) and (g)”.

5.   Regulation 11A (NRS Levy is a levy for the purposes of the collection Act)

5.1   Omit the regulation.

6.   Regulation 13 (What is the rate of levy)

6.1   Subregulation 13 (3):

Omit the subregulation.

7.   Regulation 14 (What is the rate of export charge)

7.1   Subregulation 14 (3):

Omit the subregulation.
