Primary Industries Levies and Charges Collection (Coarse Grains) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991 and the Coarse Grains Levy Act 1992.

1. Commencement

1.1 These Regulations commence on 1 February 1993.

 

2. Amendment

2.1 The Primary Industries Levies and Charges Collection (Coarse Grains) Regulations are amended as set out in these Regulations.

3. Regulation 4 (Interpretation)

3.1 Insert the following definition:

“‘ grain sorghum’ means grain harvested from grain sorghum;”.

4. Regulation 5 (What is the sales value of oats, cereal rye and grain sorghum?)

4.1 Subregulation 5(1):

Omit “subsection 11 (1)”, substitute “the definition of ‘value’ in section 3”.

4.2 Subregulation 5 (3):

Omit “or rye grain.”, substitute “, rye grain or grain sorghum.”.

5. Regulation 10 (Who must lodge quarterly returns?)

5.1 Subregulation 10 (3):

Omit “A quarterly return for oat grain and rye grain”, substitute “A quarterly return for oat grain, rye grain and grain sorghum”.

5.2 Paragraph 10(3) (a):

Omit “oat grain or rye grain”, substitute “oat grain, rye grain or grain sorghum”.

5.3 Paragraph 10 (3) (b):

Omit “oat grain or rye grain” (wherever occurring), substitute “oat grain, rye grain or grain sorghum”.

5.4 Paragraph 10 (3) (c):

Omit “oat grain or rye grain” (wherever occurring), substitute “oat grain, rye grain or grain sorghum”.

6. Regulation 11 (When must a quarterly return be lodged?)

6.1 Omit “of the month following” substitute, “after”.

 

7. Regulation 13 (Records to be kept)

7.1 Paragraph 13 (2) (a):

Omit “quantity and value”, substitute “quantity, value and source”.

7.2 Paragraph 13 (3) (a):

Omit “quantity and value”, substitute “quantity, value and source”.
