Primary Industries Levies and Charges Collection (Coarse Grains) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Primary Industries Levies and Charges Collection Act 1991 and the Coarse Grains Levy Act 1992.

1.   Commencement

1.1   These Regulations commence on 1 October 1993.

2.   Amendment

2.1   The Primary Industries Levies and Charges Collection (Coarse Grains) Regulations are amended as set out in these Regulations.

3.   Regulation 5 (What is the sales value of oats, cereal rye and grain sorghum?)

3.1   New paragraph 5 (1) (aa):

Before paragraph 5 (1)(a), insert:

  • “(aa)

    in the case of seed grain for sowing—the amount that would constitute the sale price of the grain if it were not seed grain for sowing and had been sold at the market price prevailing on the day the grain was delivered as mentioned in subsection 9 (2) of the Levy Act; and”.

3.2   Subparagraph 5 (1) (b) (ii):

Omit the subparagraph, substitute:

  • “(ii)

    if there are no sales invoices or documents of that kind—the amount that would constitute the sale price of the grain if it had been sold at the market price prevailing on the day the grain was processed, or delivered, as mentioned in subsection 9 (2) of the Levy Act.”.
