(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, and having taken into consideration relevant recommendations made to the Minister by the Australian Horticultural Corporation, make the following regulations under the Primary Industries Levies and Charges Collection Act 1991, the Horticultural Levy Act 1987 and the Horticultural Export Charge Act 1987.

1.   Commencement

1.1   These Regulations commence on 1 June 1992.

2.   Amendment

2.1   The Primary Industries Levies and Charges Collection (Avocado) Regulations are amended as set out in these Regulations.

3.   Regulation 10 (What is the rate of levy?)

3.1   Omit the Regulation, substitute:

Rates of Levy for Australian Horticultural Corporation

“10.

For the purposes of section 8 of the Levy Act, the following rates of levy are prescribed:

(a)

for avocados in bulk—$25.00 per tonne;

(b)

for other avocados—15 cents per standard tray.

Rates of levy for Horticultural Research and Development Corporation

 “10a. For the purposes of section 9 of the Levy Act, the following rates of levy are prescribed:

 (a) for avocados in bulk—$5.00 per tonne;

(b)

for other avocados—3 cents per standard tray.”.

4.   Regulation 11 (What is the rate of export charge?)

4.1   Omit the Regulation,substitute:

Rates of export charge for Australian Horticultural Corporation

“11.

For the purposes of section 8 of the Export Charge Act, the following rates of export charge are prescribed:

(a)

for avocados in bulk—$25.00 per tonne;

(b)

for other avocados—15 cents per standard tray.

Rates of export charge for Horticultural Research and Development Corporation

 “11a. For the purposes of section 9 of the Export Charge Act, the following rates of export charge are prescribed:

 (a) for avocados in bulk—$5.00 per tonne;

(b)

for other avocados—3 cents per standard tray.”.

5.   Regulation 24 (Records—5 year retention period)

5.1   Omit “regulation 26”, substitute “regulation 23”.

6.   Regulation 25 (Review of decisions)

6.1   Paragraph 25 (1) (b):

Omit “paragraph 23 (3) (a)”, substitute “paragraph 20 (3) (a)”.
