s1 2 s5 Primary Industries Legislation Amendment Regulation No. 292, 2002 (No. 1) 2002 PART 1—PRELIMINARY 1 Short title This regulation may be cited as the Primary Industries Legislation Amendment Regulation (No. 1) 2002 . PART 2—AMENDMENT OF APIARIES REGULATION 1998 2 Regulation amended in pt 2 This part amends the Apiaries Regulation 1998. 3 Insertion of new s 15B Part 3, division 3— insert ‘15B Prohibition on introducing Africanised strains of honeybees ‘For section 28(1) of the Act, the introduction of Africanised strains of honeybees ( Apis mellifera scutellata Lepeletier) is prohibited.’. 4 Amendment of s 25 (Registration fee) Section 25, ‘$10.30’— omit, insert ‘$10.60’. 5 Amendment of sch 1 (Diseases) (1) Schedule 1, part 3— insert ‘varroa mite ( Varroa destructor )’.

PART 3—AMENDMENT OF EXOTIC DISEASES IN ANIMALS REGULATION 1998 6 Regulation amended in pt 3 This part amends the Exotic Diseases in Animals Regulation 1998. 7 Replacement of s 3 (Exotic diseases) Section 3— omit, insert ‘3 Exotic diseases ‘Each disease mentioned in the schedule is prescribed for the Act, schedule 2, 1 definition “exotic disease”.’. 8 Insertion of new pt 3A After section 9— insert ‘PART 3A—INSPECTORS ‘9A Appointment of inspectors—Act, s 19A (1) Each of the following classes of persons is declared to be an approved class of persons for section 19A 2 of the Act— 1 Schedule 2 (Dictionary) of the Act 2 Section 19A (Appointment and qualifications) of the Act
s8 4 s8 Primary Industries Legislation Amendment Regulation No. 292, 2002 (No. 1) 2002 (a) persons appointed under the AnimalCareandProtectionAct2001 as authorised officers or inspectors; (b) authorised officers appointed under the StateCounter-DisasterOrganisation Act 1975 ; (c) security officers licensed under the Security Providers Act 1993 ; (d) the following persons who are retired— (i) inspectors of stock; (ii) defence force personnel; (iii) police officers; (iv) veterinary surgeons; (e) persons appointed or otherwise authorised under the law of a place outside the State— (i) to act as an inspector of stock or police officer, or its equivalent, in the place; or (ii) to practise veterinary science in the place; (f) persons who hold a degree or diploma in veterinary science of a university or other body, and who teach veterinary science at a university or veterinary school; (g) veterinary science students. (2) In this section— “defence force personnel” means members within the meaning of the Defence Act 1903 (Cwlth). 3 “inspector of stock” means a person appointed as an inspector of stock under the Stock Act 1915 . “police officer” means a police officer appointed under the Police ServiceAdministration Act 1990. “veterinary science” has the meaning given under the Veterinary SurgeonsAct 1936 , section 2A . 4 3 Defence Force Act 1903 (Cwlth), section 4 (Interpretation)— “member” —includes any officer, soldier, sailor and airman. 4 Veterinary Surgeons Act 1936 , section 2A (Meaning of “veterinary science”)
s9 5 s9 Primary Industries Legislation Amendment Regulation No. 292, 2002 (No. 1) 2002 “veterinary science student” means a person undertaking study to obtain a degree or diploma accredited by the Australasian Veterinary Boards Council Incorporated. “veterinary surgeon” means a person registered as a veterinary surgeon under the Veterinary Surgeons Act 1936 .’. 9 Insertion of new schedule After section 11— insert ‘SCHEDULE ‘EXOTIC DISEASES section 3 ‘acarine mite ( Acarapis woodii ) African horse sickness Asian mite ( Tropilaelaps clareae ) Aujeszky’s disease Australian lyssavirus (including bat lyssavirus) avian influenza virus Borna disease bovine spongiform encephalopathy Braula fly ( Braula coeca ) brucellosis (due to Brucella abortus ) brucellosis (due to Brucella melitensis ) classical swine fever contagious bovine pleuropneumonia contagious equine metritis
