  1. Name of regulation

This regulation is the Primary Industries Legislation Amendment Regulation 2012 (No. 2).

  1. Commencement

This regulation commences on 1 November 2012.

  1. Amendment of Primary Industries (Customs) Charges Regulations 2000

Schedule 1 amends the Primary Industries (Customs) Charges Regulations 2000.

  1. Amendment of Primary Industries (Excise) Levies Regulations 1999

Schedule 2 amends the Primary Industries (Excise) Levies Regulations 1999.

5.7PHA charge

  1. For clause 2 of Schedule 14 to the Customs Charges Act, PHA charge is imposed on cherries on which charge is imposed by Schedule 10 to the Customs Charges Act.

  1. For clause 5 of Schedule 14 to the Customs Charges Act, the rate of the charge for cherries is 0.03 cents per kilogram.

  1. For clause 10 of Schedule 14 to the Customs Charges Act, PHA charge imposed on cherries is payable by the producer of the cherries.

5.7          PHA levy

     (1)      For clause 2 of Schedule 27 to the Excise Levies Act, PHA levy is imposed on cherries on which levy is imposed by Schedule 15 to the Excise Levies Act.

     (2)      For clause 6 of Schedule 27 to the Excise Levies Act, the rate of the levy for cherries is 0.03 cents per kilogram.

     (3)      For clause 11 of Schedule 27 to the Excise Levies Act, PHA levy imposed on cherries is payable by the producer of the cherries.
