Name of Regulations
These Regulations are the Primary Industries (Excise) Levies Amendment Regulations 2006 (No. 4).

Commencement
These Regulations commence on 1 October 2006.

Amendment of Primary Industries (Excise) Levies Regulations 1999
Schedule 1 amends the Primary Industries (Excise) Levies Regulations 1999.

insert
Part 26 Turf
26.1Turf is a leviable horticultural product
Turf is prescribed for:
(a)paragraph (f) of the definition of horticultural products in clause 1 of Schedule 15 to the Excise Levies Act; and
(b)the definition of leviable horticultural products in that clause.
26.2What turf is exempt from levy

For paragraph 2 (4) (a) of Schedule 15 to the Excise Levies Act, turf produced by a producer who deals with no more than 20 000 square metres of turf in a levy year is exempt from levy.

In subregulation (1) deal with means:
(a)to sell within Australia; or
(b)to export; or
(c)both the activities mentioned in paragraphs (a) and (b).
26.3Rate of levy — marketing component
For subclause 4 (1) of Schedule 15 to the Excise Levies Act, the rate of levy is 0.3 of a cent per square metre of turf.
26.4Rate of levy — research and development component
For subclause 4 (3) of Schedule 15 to the Excise Levies Act, the rate of levy is 1.2 cents per square metre of turf.
26.5What is the eligible industry body for turf
For subclauses 6 (7), (8) and (10) of Schedule 15 to the Excise Levies Act, the eligible industry body for turf is Turf Producers Australia Limited (ABN 94 100 682 782).
