1Name of Regulations

These Regulations are the Primary Industries (Excise) Levies Amendment Regulations 2003 (No. 7).

2Commencement

These Regulations commence on the day on which Schedule 1 to the Dairy Industry Service Reform Act 2003 commences.

3Amendment of Primary Industries (Excise) Levies Regulations 1999

Schedule 1 amends the Primary Industries (Excise) Levies Regulations 1999.

[1]Schedule 6, clause 1, definitions of Corporation levy, promotion levy and research levy

dairy service levy means the levy imposed under paragraph 6 (1) (d) of Schedule 6 to the Excise Levies Act.

2Dairy producer levies — prescribed milk fat rate and protein rate

1. (1)

   For paragraph 10 (1) (a) of Schedule 6 to the Excise Levies Act, the following milk fat rates are prescribed:

   1. (a)

      for a dairy service levy — 2.6075 cents per kilogram;

   2. (b)

      for an Australian Animal Health Council levy — 0.0373 of a cent per kilogram.

Note For the prescribed rates of milk fat content for relevant dairy produce when it is not practicable to determine the actual milk fat content, see Schedule 3 to the Dairy Produce Regulations 1986.

   For paragraph 10 (1) (b) of that Schedule, the following protein rates are prescribed:

   1. (a)

      for a dairy service levy — 6.3558 cents per kilogram;

   2. (b)

      for an Australian Animal Health Council levy — 0.0880 of a cent per kilogram.

Note 1 For the prescribed rates of protein content for relevant dairy produce when it is not practicable to determine the actual protein content, see Schedule 3 to the Dairy Produce Regulations 1986.

Note 2 For the operative rate of NRS excise levy on relevant dairy produce, see clause 2 of Schedule 3 to the National Residue Survey (Excise) Levy Act 1998.
